Immigration to Poland
Poland is an attractive country for residence, chosen by a large number of Ukrainians. The similarity of the language, understandable conditions for employment and doing business, a large Ukrainian diaspora and territorial proximity are the factors that make living in this country the optimal choice for many. At the same time, a significant part of Ukrainians wants to have a more solid reason for living in Poland than temporary protection. So in this case, it is worth thinking about applying for a residence permit. Let’s consider the grounds that open up opportunities for its application.
Grounds for applying for a temporary residence permit in Poland
Such a permit is available to those who:
- run a business in Poland;
- work in this country;
- are studying in Poland;
- are married to a Polish citizen;
- arrived for the purpose of family reunification;
- have a Pole’s Card;
- are engaged in scientific activities in Poland.
As for the issuance of a permit based on opening a business, the company must employ at least 2 Poles or foreigners. The company’s authorized capital must be at the level stipulated by local legislation. You must also provide evidence that the company generates income – prove that it is active.
As for work in Poland, in order to issue a permit, the company must prepare an official invitation for you and a package of documents necessary for employment. Despite the fact that initially such a permit is issued for only 6 months, a foreigner has the right to extend it for a year. And when a person has already lived in Poland for a year and a half on legal grounds, he or she can submit documents to obtain a permanent residence permit.
As practice shows, employment in Poland, as a rule, becomes the most popular reason for issuing a residence permit.
By the way, it is worth mentioning separately here such an option as the Blue Card. It exists not only in Poland, but also in other countries – for example, Germany. It concerns employment and residence on the territory of the state of those highly qualified specialists who are needed by the domestic labor market.
Admission to a university in Poland is very popular among Ukrainians and provides an opportunity to obtain a temporary residence permit in this country. Foreign students highly appreciate the opportunity to travel visa-free to EU countries, study at a university with Polish and English languages of instruction, receive education for free with a Pole’s Card, and work during their studies. In addition, some universities do not have entrance exams.
Regarding such a ground as marriage, it is important to know that not only the second spouse, but also the minor children of a citizen of the country have the right to obtain a residence permit in Poland. At the same time, the inspection authorities treat this ground very carefully. They may visit you with an inspection or, for example, interview neighbors. This is done to make sure that the marriage is not a sham.
Permanent residence permit in Poland
If we talk about a permanent residence permit (or Permanent Residence Card), then it is issued for an unlimited period.
However, such a permit must be changed every 10 years. It is not necessary to confirm the presence of grounds for its issuance each time. Some consider a permanent residence permit as the next step on the path to obtaining Polish citizenship. The grounds for issuing such a permit are:
- continuous residence in this country on legal grounds for 5 years;
- Polish origin or Pole’s Card;
- 3 years married to a Polish citizen, of which 2 years fall on the stage of continuous residence in this state.
When migration law specialists who are part of the team of the law firm “Prikhodko & Partners” are contacted regarding issues of a permanent residence permit in Poland, we will tell you in detail about the mechanism for its issuance on the basis that is relevant in your case.
What are the grounds for obtaining Polish citizenship?
Regarding the registration of Polish citizenship, the following grounds are relevant:
- by birth;
- by recognition as a Polish citizen;
- on the basis of the restoration of Polish citizenship for those persons who previously had it;
- on the basis of granting Polish citizenship by the President of this country.
The most common method is recognition as a Polish citizen. The procedure is carried out administratively and can take place according to different scenarios, depending on the specific situation of the applicant.
For example, the following are possible options:
- a person has legally resided in Poland for 3 years, having a permanent residence permit;
- has a regular and stable source of income in this country;
- has the right to housing.
There is also a possible option of legal 2-year residence on the basis of a permanent residence permit and 3 years of marriage to a Polish citizen.
Another possible scenario is when a person has resided in Poland for 2 years continuously, using a permanent residence permit for refugees.
And the last option is when a person legally resides in Poland for a permanent period of one year and has a permanent residence permit, which he received on the basis of Polish origin or the Pole’s Card.
