Enterprises designated as critical are required to periodically confirm their compliance with established criteria. For many companies, the next confirmation deadline is as early as January 2026, making timely and accurate completion of this process particularly important. When should I submit documents to confirm criticality?
Companies are required to renew their status annually. This means documents should be submitted approximately one to two months before the status expires, as the formal deadline of ten business days may be insufficient due to potential delays in review. It’s best to submit the application package early to avoid problems, for example, beginning preparations in November if the status expires in January 2026.
Process confirmation of the status of a critical enterprise
Confirming criticality is essentially the same as initially obtaining this status. However, the process is simpler, as the company already understands the requirements and procedures for interacting with the authorized body. Overall, the process consists of several key stages:
- Preparing a package of documents
The company completes an application and provides proof of compliance with the criteria of Cabinet of Ministers Resolution № 76. This package includes financial documents, employee information, tax information, and other materials confirming compliance with at least three criteria.
- Submission of documents to the relevant authority
The application is submitted to the relevant ministry or military administration, depending on the company’s area of activity. It’s important to ensure that the application package is complete in advance to avoid delays.
- Verification and analysis of the request
The authorized body evaluates the documents and, if necessary, requests clarification or additional materials.
- Decision making
After analysis, organizations either confirm or deny the critical status. If approved, the status remains in effect, and the company retains the right to reserve employees. If violations or non-compliance with the criteria are found, the status may not be confirmed, but a reapplying request is permitted once the deficiencies are corrected.
Have the criteria for qualifying as a critical facility changed?
Resolution № 1475 significantly updated the Procedure established by Cabinet of Ministers Resolution № 76. These changes are aimed at adapting the reservation mechanisms to the needs of the defense sector and the economy. It is important to note that these changes also update the regional and industry-specific criteria for defining critical enterprises. This means that if you plan to reapply for or confirm critical status, your enterprise must meet the new requirements. How long does it take to consider criticality?
By law, document review takes 10 business days. However, in practice, this period is often extended, so it is recommended to submit documents in advance. For bookings through “Diya”, the review period may be shorter – approximately 72 hours.
How do I rebook an employee after confirmation?
Once a company has successfully confirmed its critical status, the employee reservation remains valid only for the period specified in the previous reservation decision. After this period, the reservation is not automatically extended; the employer must re-register it through “Diya”.
