Main taxes in the USA: federal and state level
The US tax system is one of the most multi-tiered in the world. Taxes are paid at the federal level, as well as at the level of individual states and local governments.
Main types of taxes:
- Federal Income Tax: progressive rate from 10% to 37% for individuals. For legal entities – a fixed rate of 21%.
- State Income Tax: not all states have it. For example, Florida and Texas have no state personal income tax, while California has a rate of up to 13.3%.
- Social Security Tax and Medicare Tax: mandatory contributions (6.2% and 1.45%, respectively) from the income of employees and employers.
- Sales Tax (similar to VAT): varies by state, for example, in New York — 8.875%, in Texas — 6.25%.
- Self-employment Tax: for self-employed individuals (e.g. freelancers or small business owners) the rate is 15.3%.
Stages of tax declaration and payment: examples for individuals and legal entities
Individuals:
- Obtaining an ITIN or SSN: This is a personal identifier for tax reporting.
- Forming an annual tax return (Form 1040): includes income from wages, investments, and business.
- Filing a declaration: by April 15 of each year. Extension of the deadline to October 15 is possible.
- Tax payment: all at once or in installments throughout the year (through the Estimated Tax Payments system).
Legal entities:
- EIN (Employer Identification Number) registration.
- Choosing a taxation type (C-Corp, S-Corp, LLC, etc.).
- Formation of corporate declaration (forms 1120, 1120-S, 1065 depending on the structure).
- Quarterly reporting and tax payment (Form 941).
Example: A Ukrainian company that opened a subsidiary LLC in Delaware files an annual Form 5472 on ties to foreign founders. Late filing incurs a $25,000 penalty.
What documents are required? State-by-state package
Typical set of documents:
- Tax Identification Number (SSN, ITIN, or EIN).
- Income statements (Form W-2, 1099).
- Bank statements, including from foreign accounts.
- Confirmation of deductible expenses (treatment, education, charity).
- Contracts with the employer or contractors.
Interesting examples:
- In Florida, non-residents with real estate income must file Form 1040NR.
- In California, an additional form, Form 540NR, is filed for partial residents.
- In New York, businesses must file Form NYS-1 quarterly.
