Is it possible to get Ukrainian citizenship for investments?

If you answer this question briefly, then you need to go through several stages here. It is impossible to immediately become a citizen, being an investor in Ukraine. However, you can first issue a residence permit, and later apply for citizenship. It was not for nothing that the government of our country developed a program that helps investors in the Ukrainian economy to become citizens of Ukraine over time.

The Law of Ukraine “On Immigration”, namely its Article 4, provides that permission to immigrate to Ukraine is granted to persons who have invested in our economy an amount which, when converted into foreign currency, is not less than 100 thousand US dollars.

Foreigners often ask questions about whether the purchase of housing in Ukraine – for example, a house or an apartment – is considered an investment. Unfortunately, the answer here will be negative, since those funds that work in the economy, and not those that a person spends on his own needs, are considered investments. The criteria for investment in this context are profit or social impact. If we speak in the language of practical examples, we are talking about opening a company with a certain authorized capital, purchasing a part of it or establishing an investment fund.

What documents are required for an immigration permit?

As already mentioned, it is not possible to immediately apply for citizenship through investment, so you should start with an immigration permit. For this, you need to collect a certain package of documents. It is about:

• passport document of a foreigner;
• a document regarding the place of residence;
• copies of the charter and/or registered agreements (contracts) on investment activities;
• a certificate from a banking institution, which confirms that the converted foreign currency has received investments in the economy of Ukraine;
• a certificate confirming that the foreigner does not have a criminal record in the country of his residence (if he legally resides in Ukraine, then this must be a certificate about the absence of a criminal record in Ukraine);
• a document stating that the person is not suffering from chronic alcoholism, drug addiction, drug addiction or infectious diseases, the list of which is determined by the central executive body, which ensures the formation of state policy in the field of health care;
• a receipt certifying the payment of the state duty and/or consular fee.

It is important that the package of documents is not only completely collected, but also legalized and translated into Ukrainian. Otherwise, they will not be able to take it into consideration and will have to make repeated attempts to collect and submit documentation, which would take a lot of time.

As for the mechanism of submitting documents, it can happen in person. The application can be submitted to:

• consular institution of Ukraine abroad in the country where you live;
• State Migration Service in Ukraine, if you legally reside in Ukraine.

Such an application is considered within 6 months from the moment it was submitted.

When a foreigner receives a residence permit, the widest range of rights possible for a non-resident in Ukraine becomes available to him. And already 5 years after living here under such conditions, according to the norms of the current legislation, the investor can apply for a Ukrainian passport.

It should be understood that the procedure for obtaining a residence permit, and in the future, Ukrainian citizenship, is difficult for investors in the context of legal regulation.
