The procedure for determining the amount that may be subject to reimbursement is regulated by Article 200 of the Tax Code of Ukraine. For a legal entity to obtain a VAT refund, it is important that the amount claimed for reimbursement corresponds to the amount of tax actually paid to suppliers of goods or services or to the State Budget of Ukraine and does not exceed the registration amount determined in accordance with Article 200¹ of the Tax Code of Ukraine at the time the tax return is received by the regulatory authority.

Documents and Grounds for VAT Refund
The main prerequisite for obtaining a budget VAT refund is a properly formed negative VAT balance and a documented input VAT credit. Therefore, even before submitting the tax return, businesses should verify not only the accuracy of the calculations, but also the documents on the basis of which the relevant figures were formed.
Depending on the nature of the business transactions, the following documents may be provided to confirm the right to a VAT refund:
contracts with suppliers and customers;
delivery notes and consignment notes;
certificates of completed works or services rendered;
tax invoices and adjustment calculations registered in the Unified Register of Tax Invoices;
payment instructions, bank statements, and other documents confirming payment;
customs declarations – in the case of import transactions;
documents confirming the origin, movement, and use of goods;

The VAT refund procedure in Ukraine consists of several consecutive stages.

Who is entitled to a VAT refund?
Registered VAT payers who, based on the results of the reporting period, had a negative tax value and fulfilled the conditions established by Art. 200 PKU. In particular, the amount declared before the return must be actually paid to the suppliers of goods/services or to the State Budget of Ukraine and not exceed the registration limit of the VAT payer.
How does VAT reimbursement work?
The taxpayer determines the negative value amount intended for budget reimbursement and reports it in the VAT return. Subsequently, the claimed amount undergoes a desk audit and, in cases prescribed by law, a documentary audit. Reimbursement is effected after the claimed amount has been approved by the controlling authority.
What amount can be claimed for VAT reimbursement from the budget?

After the documents are submitted, the State Tax Service verifies the validity of the claimed amount.
Is the budgetary refund of VAT carried out during martial law?
Yes. Martial law in itself does not negate the right of VAT payers to a budget refund. The refund mechanism remains in effect in 2026, and the State Tax Service publishes data on the actual amounts of VAT refunded from the state budget. However, specific special VAT rules apply to certain transactions during martial law; therefore, the feasibility of claiming a specific amount must be assessed based on the nature of the enterprise’s operations.
