Registration of permanent care for the wife
In modern Ukrainian society, the issue of organizing care for family members who need constant support is becoming increasingly urgent.
The issue of organizing care for a wife who, due to her health condition, requires constant care is especially acute.
As experienced lawyers at “Prikhodko & Partners”, we help Ukrainian families resolve such issues every day and want to share key information on this issue.

Legislative basis
Legal regulation of family care in Ukraine is based on the fundamental principles of social protection enshrined in the Constitution of Ukraine.
The main legislative basis is the Law of Ukraine “On State Social Assistance to Persons with Disabilities from Childhood and Children with Disabilities”, as well as the Law of Ukraine “On Social Services”.
These regulatory legal acts establish the basic principles of providing assistance and regulate the mechanisms for its receipt. In addition, the issue of care is regulated by a number of resolutions of the Cabinet of Ministers of Ukraine, which determine specific procedures and the order of providing social services.
Features of formal care registration
The process of formalizing the care of a spouse requires a careful approach and understanding of all legal aspects. First of all, it is necessary to contact a medical institution to undergo a medical and social examination.
The Medical Advisory Commission (MAC) conducts a comprehensive examination and provides a conclusion on the need for constant care. This document is fundamental for the further registration of all necessary documents.
The next important step is to contact the social protection authorities. It is important to understand that the social protection system in Ukraine provides various forms of support for families where one of the members needs constant care.
This can be both direct financial assistance and the provision of social services through territorial social service centers.
Documentation and procedural aspects
To begin the procedure for registering care, it is necessary to prepare a full package of documents. The basis is the passports of both spouses and a marriage certificate, which confirm family ties.
Medical documentation should include not only the conclusion of the MAC, but also a complete medical history, justifying the need for constant care.
An important aspect is the submission of documents on the financial situation of the family. This includes certificates of income of all family members, including pensions, salaries and other types of social benefits.
This is necessary to determine the amount of possible state assistance and assess the family’s overall need for social support.
Rights and responsibilities in the care system
Applying for permanent care for a spouse not only provides certain rights and benefits, but also imposes serious responsibilities on the caregiver.
The caregiver must provide full-fledged care, including assistance in everyday life, compliance with medical recommendations, and ensuring proper living conditions and nutrition.
It is important to understand that the state regularly monitors the quality of care services.
This includes periodic inspections by social workers, the need to report on the health of the ward and the use of state assistance.
In the event of violations or improper performance of care duties, the payment of assistance may be suspended and other sanctions may be applied as provided for by law.
Financial aspects and social guarantees
The state provides various forms of financial support for families caring for a person in need.
The amount of assistance is calculated individually and depends on many factors, including the degree of disability of the person in need of care, the total family income, and the availability of other types of social assistance.
Deferment from military service to care for a spouse
The issue of receiving a deferment from military service for men who are constantly caring for their wives deserves special attention.
According to the current legislation of Ukraine, the right to a deferment from military service during mobilization is granted to men who are dependent on a wife with disabilities and/or chronic diseases requiring constant care.
This right is enshrined in the Law of Ukraine “On Military Duty and Military Service” and specified by relevant resolutions of the Cabinet of Ministers of Ukraine.
