Construction work license
A construction license in Ukraine grants the right to carry out the types of construction activities specified in the List approved by the Resolution of the Cabinet of Ministers of Ukraine No. 406. The need to obtain such a license depends on the class of consequences of the construction object and the type of construction work, respectively. If an entrepreneur plans to officially carry out the construction of new objects in Ukraine, it is important for him to follow the established procedure for obtaining it from the licensing authority.
For which construction works a license is (not) required?

A construction license is required for:
- construction of objects of consequence class CC2 and CC3 (these include multi-apartment residential buildings, shopping and
- entertainment centers, industrial facilities, energy facilities, transport infrastructure, etc.);
- construction and installation of engineering and transport infrastructure;
- electrical installation work.
At the same time, a construction license is not required for the following activities:
- redevelopment of residential and non-residential buildings, structures and premises, if these works do not involve interference with the
- enclosing and supporting structures;
- major repairs of heating, ventilation, water supply, low-voltage systems;
- construction of temporary buildings and structures (arbors, greenhouses, garages, etc.);
- work on the restoration of children’s and sports grounds, adjacent territories;
- construction of fortifications for troops;
- new construction of facilities belonging to the CC1 impact classes.

How to obtain a license for construction work?
Requirements for the applicant
A business entity (legal entity or individual entrepreneur) must meet the following eligibility criteria to undergo assessment by the licensing authority:
- choose KVED 41.20, 42.1, 42.2, 42.9 or 43.3, respectively;
- have sufficient material and technical base to perform the relevant activity (construction machinery, equipment, tools, warehouses);
- form a staff with a minimum number of qualified personnel (hire a director, accountant, builders);
- have a certified QMS (quality management system), in particular for performing construction work on objects of the CC3 impact class;
- prove the presence of appropriate conditions and measures for labor protection at the enterprise (at the request of the licensing authority), which may consist in obtaining additional permits for performing high-risk work from the State Labor Service.
Required documents
During martial law, for proper licensing of construction activities, a business entity must submit to the authorized state body a declaration for construction work and accompanying documents as required by the Resolution of the Cabinet of Ministers of Ukraine No. 314. As a general rule, the list of required documentation is as follows:
- declaration of the established form;
- a copy of the extract on the registration of the business entity;
- a copy of the manager’s passport;
- construction documents (project, contract agreements, etc.);
- documents confirming the availability of appropriate personnel and material and technical base (diplomas, certificates, purchase and sale agreements, lease of machines, equipment, premises, extracts from the State Register of Real Estate and Property Registration confirming private property rights);
- other documents that may be required by the licensing body in accordance with current national legislation.
Who issues a construction license?
Construction licenses are issued by the State Urban Planning Inspectorate of Ukraine. The permit itself is issued indefinitely after a thorough assessment of the full package of documents, which takes from 10 to 30 calendar days. You can submit a request for a permit to the licensing authority online via “Diya” or by official e-mail, by sending a letter of recommendation with a description of the attachment to the address of the location.
