Payment of one-time monetary assistance to military personnel

How to receive one-time monetary assistance for an injury and how is this regulated?

Payments for injuries are made in accordance with the Resolution of the Cabinet of Ministers of Ukraine “Issues of certain payments to military personnel, privates and commanding officers, police officers and their families during martial law” dated 02/28/2022 № 168.

The issue of social protection of military personnel injured while defending the Motherland is extremely important. In 2022, at the very beginning of a full-scale invasion, the Cabinet of Ministers of Ukraine adopted Resolution № 168, which determines the procedure for paying a lump sum benefit in the event of death, injury (contusion, trauma, injury) related to the defense of the Motherland, as well as in the event of disappearance missing military personnel of the Armed Forces of Ukraine and other military formations.

 

What amount of payments is provided and what is necessary to receive them?

The amount of one-time assistance is 100,000 hryvnia. Such monetary compensation is accrued on the basis of orders of commanders (chiefs).

It should be noted that payment for injuries (concussion (acoustic trauma), trauma, mutilation) is paid only if the conclusion of the Military Military Commission states that they are related to the defense of the Motherland and, according to Order of the Ministry of Health № 370, are classified as severe.

It is important to note that:

  • Such funds are paid in a lump sum.
  • It does not depend on length of service.
  • It is not taxed.
  • Family members of a deceased (deceased) serviceman have the right to one-time assistance in the amount of 1,500 subsistence minimums for able-bodied persons.

Procedure for receiving payments

  • The first thing a service member needs to have on hand is Form 100. It must be filled out by the first aid provider;
  • The next step is to obtain Appendix № 5, that is, a Certificate of Injury Circumstances (wound, injury, concussion), which is provided on the basis of an order to the commander as a result of an official investigation into the circumstances of the injury;
  • After receiving the previously specified package of documents, it is necessary to establish the cause-and-effect relationship of the injury (wound, injury, concussion), which is indicated in the conclusion of the IHC;
  • In general, the law does not establish the duty of a military serviceman to apply for a one-time benefit, but in practice, unfortunately, these appropriate payments are rarely accrued automatically.

What to do if all of the above steps have been completed and there are still no payments?

First of all, with the existing package of documents, it is necessary to prepare a report on receiving proper payments. It is advisable that the report be prepared by an experienced lawyer, because this can immediately prevent such a situation when the commander tells you that the report was drawn up incorrectly, not in the form, etc. It would be effective to send a report along with a cover letter through the OK, General Staff of the Armed Forces of Ukraine, MOU or the Command of the corresponding branch of the military. Also, it should be noted that if as a result of an injury (wound, mutilation, contusion) you were sent to inpatient treatment, then you have the right to receive additional monetary compensation (combat) for each month of inpatient treatment.

How far in advance do I need to submit documents?

To submit the required package of documents, the stipulated period is three years from the moment of death (death), injury (concussion, injury, mutilation) or missing in action of a serviceman.

The Cabinet of Ministers’ Resolution № 168 itself is an important step in ensuring social protection for military personnel who were injured or died while defending the Motherland. The payments provided for by the Resolution will help them and their families overcome difficult life circumstances associated with injury or loss of a breadwinner.
