How to Renounce Citizenship of Ukraine?
When a person wants to change citizenship, he or she asks what to do with the citizenship of the state with which he or she currently has political and legal relations. For example, when it comes to Ukrainian citizenship, a mere desire to renounce it is not enough. There must be grounds provided for by law. If you need legal advice on this topic, the specialists of Prikhodko & Partners Law Firm will answer your questions. We also provide services to support client requests during interaction with government agencies that are authorized in such matters.
What should I know about renunciation and loss of Ukrainian citizenship?
There are 2 ways a person can cease to be a citizen of Ukraine. These are renunciation or loss of Ukrainian citizenship. Renunciation is voluntary, and loss of citizenship occurs when a person has already acquired the citizenship of another state. However, a unilateral renunciation of Ukrainian citizenship, which leads to statelessness, is impossible. This is how these issues are regulated by the current legislation. In order to cease to be a citizen of Ukraine, one must have a passport of another state or a document certifying a guarantee of obtaining the citizenship of another state after renouncing Ukrainian citizenship.
When it comes to traveling abroad, you must have the appropriate permission from the authorized state bodies. Today, the procedure for renunciation of citizenship is possible only through the Ukrainian embassy after completing another procedure – departure for permanent residence. Despite the estimated declared period of up to 3 months, in practice this process often takes up to 6-8 months. The overload of the State Migration Service and the human factor create a complex problem that hinders a quick resolution of the issue.
However, professional legal support makes it possible to influence the situation to some extent and simplify it for the client for several reasons:
- A lawyer has more authority when interacting with authorized government agencies.
- A specialist with duly executed representation powers can interact on behalf of the client in all those matters that do not require his or her personal presence.
Thus, high-quality representation of interests greatly simplifies the client’s life and saves him or her time and effort.
What are the grounds for losing and renouncing citizenship?
When it comes to the loss of Ukrainian citizenship, the grounds for it may be as follows:
- An adult citizen voluntarily acquired the citizenship of another state.
- Acquisition of Ukrainian citizenship was illegal due to the fact that the person submitted false information and/or forged documents.
- The person voluntarily became a military servant of another state.
When we are talking not about the loss, but about the withdrawal of Ukrainian citizenship, this is possible for
- Those citizens of Ukraine who permanently reside in another state;
- children who have moved to another country for permanent residence with their parents or one of their parents (in this case, a corresponding application is required from one of the parents)
- children who were granted Ukrainian citizenship at birth, but one of their parents is a resident of another country;
- children adopted by residents of another country.
In order to renounce Ukrainian citizenship, you need to prepare an accompanying package of documents to be submitted with your application. The list of required documentation will differ depending on who the person renouncing citizenship is. This list will be different for adults and minors. It will also differ depending on the grounds on which the person renounces Ukrainian citizenship. When advising their clients, the lawyers of the Prikhodko & Partners Law Firm provide them with detailed guidance on these issues.
