Hazardous waste license

Hazardous waste license (hereinafter referred to as “HW”) is an important element of regulation and control over the circulation and disposal of waste that has a potentially harmful effect on the environment and human health.

Hazardous waste (HW) management activities in Ukraine are regulated by several laws and regulatory acts that determine the procedure for obtaining a license to carry out such activities. Therefore, obtaining a license is mandatory for business entities that plan to collect, transport, process, dispose of, or remove hazardous waste.

The first step in the process of obtaining an HW license is to understand what exactly is considered hazardous waste according to current legislation.

Legislation clearly defines the criteria and characteristics of waste that fall under this term.

The main regulatory and legal acts regulating the procedure for obtaining a license for HW are:

• Law of Ukraine “On Licensing Types of Economic Activity”;
• Resolution of the Cabinet of Ministers of Ukraine “On Approval of Licensing Conditions for Conducting Business Activities on Hazardous Waste Management”;
• Order of the Ministry of Ecology and Natural Resources of Ukraine “On Approval of the Procedure for Issuing a License to Conduct Business Activities for Hazardous Waste Management.”

Applicants for a hazardous waste license will have to meet certain criteria and meet specific requirements. This may include the availability of the necessary technical base, qualified personnel, and other aspects.

List of documents for obtaining a license

To obtain a license for HV, the applicant submits the following documents to the Ministry of Ecology and Natural Resources of Ukraine (Mindovkillya):

• Application for the issuance of a license for the HW;
• A copy of the statement of the company, confirming the entry into the UDR;
• A copy of the company’s statement of state registration of a legal entity;
• Data on the responsible person – the head of the company;
• Documents confirming the availability of material and technical base and qualified personnel;
• Availability of contracts on collection, disposal, transportation, or processing of hazardous waste;
• Confirmation of license fee payment;
• Other documents determined by the Ministry of Environment.

The procedure for obtaining an HW license consists of the following stages:

• Preparation and submission of documents to the Ministry of Environment;
• Review of Ministry of Environment documents (up to 30 calendar days);
• Deciding on issuing or refusing to issue a license;
• Issuance of a license (in case of a positive decision).

As for the period of issue – the license for the HW is issued for 10 years.

The cost of a license for an aircraft depends on the type of activity and class of danger of the aircraft and is determined separately.

After obtaining a license, the subject is obliged to fulfill several duties regarding the collection, transport, disposal, and other aspects of hazardous waste management.

As for liability for violation of license conditions, administrative and criminal liability is provided for violation of license conditions.
