Who needs to file a NACP declaration for civil servants?
Today, a separate list of those civil servants who, while performing the functions assigned to them by the state, are obliged to file a NACP declaration on time. Thus, according to Part 1, Article 3 of the Law of Ukraine “On Prevention of Corruption”, the subjects of income declaration are:
- officials of ministries, services, other heads of central government bodies;
- deputies, mayors in cities, towns, and villages;
- officials of military formations;
- judges, their assistants;
- employees of the prosecutor's office, the Security Service of Ukraine, the State Border Guard;
- officials working in the National Anti-Corruption Commission;
- representatives of the diplomatic service and others.

Filling out a NACP declaration by a civil servant: key points
The general rules for filling out a NACP declaration are currently set out in the relevant Procedure for Filling Out and Submitting a Declaration. Analyzing its legal provisions, we can formulate the following theses:
- correctly filled-in declaration must contain information not only about the subject of the declaration, but also about his family members (and their sources of income, respectively);
- the declaration of objects (income) takes place regardless of their location, therefore the civil servant must also cover his foreign income, real estate objects, etc. in it;
- the declaration to the NACP for a civil servant is filled out on the basis of documents confirming the right of ownership to real estate objects;
- in the declaration, civil servants must also reflect those objects and income that are in their use (different from the right of personal property) as of the reporting period;
- the declaration must necessarily include property that belongs to third parties, but the civil servant (or a member of his family) receives income from it;
- in the declaration to the NACP for a civil servant, certain values are subject to rounding (area of the object, value of securities, share in the authorized capital), in the rest - it is necessary to indicate exact prices for more transparent disclosure;
- other items established by this Procedure.
Thus, the main principles in filling out a declaration by a civil servant are the obligation to provide information about themselves and their family members, documentary confirmation of the data, and the correct determination of the value of the declared property.
Rules for submitting a NACP declaration for civil servants
There are various ways for a civil servant to submit a declaration to the NACP, such as: through the electronic system after authenticating the civil servant in his personal electronic account (the Unified State Register of Declarations); or by registering by filling out a form through the “Diya” Portal. The obligation of the declaring subject to be physically present at the NACP is not provided.
The general terms for submitting a declaration to the NACP by a civil servant are as follows:
- for an annual declaration - from January 1 to April 1 for the previous calendar year;
for declarations upon dismissal of a civil servant - within 30 calendar days after the termination of activity.
