Determination of a current bank account for spending transactions

A current account for spending transactions is an account specially opened or determined from the middle of the debtor’s existing accounts that have been seized. It makes it possible to make certain payments, despite the restrictions.

Basic rules

When a debtor’s money is seized, only one checking account can be used to make expenses during the country’s martial law. This applies both to accounts in the same bank and in different ones. This enables the debtor to meet basic needs, even if his funds are seized. It also simplifies control of the debtor’s expenses by the enforcement service.

The procedure for working with such an account is determined. Chapter XIII of the Final and Transitional Provisions of the Law of Ukraine “On Executive Proceedings” No. 1404-VIII;

How much money can you spend?

During martial law, it is possible to spend from such an account within one month an amount that does not exceed two amounts of the minimum wage, established by the Law on the State Budget of Ukraine as of January 1 of the current year.

Expenses can be any:

  • Primary needs: food, clothing, medicine, basic necessities.
  • Mandatory payments: housing and communal services, taxes, fees.
  • Treatment and education: medical and educational services.
  • Entrepreneurial activity: costs associated with running a business.

The procedure for determining the current account

Collect the necessary documents:

  • Passport of a citizen of Ukraine;
  • Identification code;
  • A document confirming the seizure of funds (decision on seizure, writ of execution, etc.);
  • Certificate from the bank about opening a current account.

Submit an application. It can be submitted in person or by mail to the state body or private executor that seized the funds. In the application, specify:

  • Name of the debtor;
  • Current account details;
  • Name of the bank in which the account is opened;
  • The amount you request to be determined for expense transactions (no more than two minimum wages).

Get a resolution:

  • No later than two working days after receiving the application, the executor makes a decision on establishing a current account for spending operations.
  • The resolution is sent to the bank, as well as, if available, to other executors who conduct business with the debtor.

Start using the account. After receiving the resolution, you can use the account for spending transactions within the specified amount.

Please note that the debtor is responsible for the accuracy of the information in the application.
