When a person dies, a number of legal issues arise for his loved ones related to confirming the fact of death.
In Ukraine, this is certified by a civil status act issued by a state body — a death certificate.
Within our country, such a document has full legal force and is recognized without any additional procedures.
But the situation changes when it is necessary to use the certificate abroad
For example:
- registration of inheritance remaining in another state;
- receiving social or pension benefits;
- confirmation of family status when applying for visas or residence permits;
- settlement of issues with banking or insurance organizations.
For such cases, it is necessary to ensure international recognition of the document. And this is where the need for an apostille arises.
Regulatory framework
The legal regulation of apostille of documents is based primarily on the provisions of the Hague Convention of October 5, 1961, which abolished the obligation of double diplomatic legalization of documents.
Instead of a lengthy and complicated procedure, the participating states agreed on a single simplified form — an apostille.
In Ukraine, the procedure for affixing an apostille is determined:
- the Law of Ukraine “On International Treaties”;
- resolutions of the Cabinet of Ministers;
- instructions of the Ministry of Justice, the Ministry of Education and the Ministry of Foreign Affairs (each in its own field).
It is worth emphasizing the difference:
- Apostille is valid only in countries that have joined the Convention.
- If the state is not a party to it, consular legalization is required.
What is an apostille on a death certificate
An apostille is a special stamp or sheet that certifies:
- signature of the official who issued the document;
- its status;
- authenticity of the seal or stamp of the organ.
It does not change or supplement the content of the death certificate, but only confirms its validity for international use.
The most common cases when an apostille is required for a death certificate:
- inheritance cases abroad;
- confirmation of the fact of death in migration procedures;
- receiving insurance or social benefits in international companies;
- enforcement of foreign court decisions related to property or family rights.
Procedure for obtaining an apostille in Ukraine
In Ukraine, the right to affix an apostille to a death certificate belongs to the Ministry of Justice and its territorial bodies.
Stages of the procedure:
- Applicant’s application (personally, through a representative or with the help of a notarized power of attorney).
- Submission of a package of documents:
- original death certificate;
- an application of the established form;
- applicant’s passport;
- receipt of payment of the administrative fee.
- Affixing an apostille on a document or issuing a refusal (in cases where the document is damaged or improperly executed).
Terms: usually up to 5 working days, but accelerated registration is possible.
Cost: regulated by state tariffs, however, the price of private intermediaries can be much higher.
Particular attention should be paid to old documents: sometimes they first need to be exchanged for new samples at the registry office, and only then submit for an apostille.
Apostille in an international context
Apostille is recognized in all countries participating in the Hague Convention, including most European countries, the USA, Australia, Japan, Brazil and others.
However, problems can arise in the following cases:
- if the country has not ratified the Convention (for example, Canada or several Middle Eastern states);
- if a foreign institution additionally requires a notarized translation or certification.
Therefore, it is important to find out the requirements of a particular country before submitting documents.
Practical aspects and common problems
In practice, difficulties often arise:
- Old-style documents (with old seals or forms). They have to be replaced.
- Translation inconsistencies. Different countries have specific requirements for the language and form of translation.
- Double requirements. Some institutions formally recognize an apostille, but in fact ask for additional confirmations.
To avoid problems, it is recommended to translate with sworn translators in the country where the document is planned to be submitted.
Alternatives to Apostille
If an apostille is not used (for example, for the United Arab Emirates, Kuwait or China), consular legalization is required.
The procedure is more complicated:
- first, the document is certified by the Ministry of Justice;
- then at the Ministry of Foreign Affairs;
- then at the consulate of the destination country.
Sometimes there are bilateral treaties between states that completely cancel legalization. For example, there are agreements between Ukraine and Poland that greatly simplify the mutual recognition of act documents.
