Removal from the unified register of debtors

The Unified Register of Debtors (ERB) is a public online resource maintained by the Ministry of Justice of Ukraine. It contains information about debtors who have unfulfilled property obligations.

ERB is a public online resource maintained by the Ministry of Justice of Ukraine. It contains information about debtors who have unfulfilled property obligations.

The main goals of ERB:

  • Ensuring transparency and publicity of information about debtors.
  • Protection of creditors’ rights.
  • Encouraging debtors to repay debts.
  • The main problem that citizens face.

The main difficulties faced by citizens due to registration in ERB

Most often, people face a problem when a record about them in the ERB remains, even after the debt has been repaid or the enforcement proceedings have been closed. This can greatly complicate life, because information from the registry is available to everyone, and can become an obstacle for:

  • Registration of notarial agreements: purchase and sale of real estate, vehicles, land plots, etc.;
  • Obtaining a loan: banks and other financial institutions check potential borrowers for debts;
  • Travel abroad: Some countries may restrict entry to individuals who have outstanding obligations.

At the same time, sometimes a person is not at all aware that there is such a record about him. For example, he goes to the notary to draw up an agreement on the sale of an apartment, and only there he learns that there is a problem. This is not only unnecessary stress, but also the risk of breaking the deal with the buyer.

Who and when enters information into this register?

Information about debtors is entered into the ERB by state and private executors based on court decisions. The reason can be not only credit debts, but also non-payment of taxes, alimony, etc.

When is information from the registry deleted?

Information about the debtor is deleted from ERB within 3 working days from the date:

  • Debt repayment. after the debtor fully pays the debt, interest and fines, the executor is obliged to issue a resolution on the end of the enforcement proceedings and the removal of information about the debtor from the ERB;
  • Closure of executive proceedings: on other grounds provided for by law, for example, in connection with the death of the debtor.

What to do if the enforcement proceedings are closed, but the entry in the register of debtors remains?

This happens, both for technical reasons, and due to careless work of the executor who forgot to issue a decision to remove the debtor from the register. In this case, you need:

  1. Contact the state or private executor who conducted the enforcement proceedings with a written request to withdraw information from the ERB.
  2. Obtain a resolution on the termination of executive proceedings.
  3. Submit a copy of the resolution to the Ministry of Justice of Ukraine.
  4. Advantages of professional help
