Registration of a deferment from mobilization
Mobilization is an integral part of preparing the country’s defense capability, but in some cases citizens may receive a deferment from military service. This right is provided by law and is granted on the basis of clearly defined conditions, such as health, family circumstances, professional activity, etc.
Who is eligible to receive a deferment?
The grounds for granting a deferment are divided into several categories:
- For health reasons – disability or a conclusion of the MMC on unsuitability (for 6-12 months).
- For students and teachers – receiving education in full-time or dual form, as well as teachers and researchers (subject to employment from 0.75 of the rate).
- For family circumstances – independent upbringing of a child, care for sick relatives, having three or more children or supporting a minor child with a disability.
- For employees of critically important enterprises – reservations for civil servants, energy sector workers, doctors, rescuers, communications workers, etc.
- For relatives of the deceased, missing in action or former prisoners.
- Other grounds specified in the Law of Ukraine “On Mobilization Preparation and Mobilization”.
How to submit documents to the TCC for a deferment?
In order to obtain a deferment, a person has the right to use the following methods:
- Through Reserve+.
Available for some citizens, in particular, in the case of a deferment for disabled people, parents with many children, as well as for students/graduate students/doctoral students.
- In person through the TCC or by mail.
To do this, you should write an application for a deferment to the TCC where you are registered and provide attachments confirming the right to a deferment.
Documents confirming the right to deferment
The list of documents required to obtain a deferment depends on the specific reason. Each case requires its own set of documents confirming the legality of the deferment.
In general, such documents may be:
- Birth/marriage certificate;
- Disability certificate and other medical certificates of illness;
- Reservation extract;
- Guardianship decision;
- Certificate from educational institution/place of work;
- Court decision on recognition of missing person;
- Extract from the order on exclusion from personnel.
For example, if a deferment is needed for a student, his status is confirmed by data from the Unified state electronic database on education issues (USEDE), and an application can be submitted through the Reserve+ electronic account.
If a deferment is required for personal care, the following documents are required:
- Certificate of need for permanent care / statement from the expert team / conclusion from the MAC;
- Certificate of care / certificate of social assistance or compensation.
How long does it take to process a deferment application?
The review period should not exceed 7 days from the date of receipt of the documents. The period may be extended if additional requests are sent to government agencies regarding the citizen.
For how long is a deferment from mobilization granted?
The period of deferment depends on the reason for deferment and is no longer than the period of martial law – 90 days (approximately 3 months). When the deferment period expires, the conscript must extend it by submitting documents again to the TCC.
How do TCC communicate about a postponement?
If a positive decision is made to grant a deferment, the TCC formalizes this with a corresponding protocol. On its basis, the person is issued an official certificate confirming the right to a deferment.
If a deferment is denied, the citizen is informed of this in writing, with an official notice explaining the reasons for the refusal.
