Allocation of land for construction
Quite often, we are approached by clients who wish to obtain land from the state or local government for construction (development). Given the martial law, the Final Provisions of the Land Code of Ukraine establish restrictions on the possibility of privatization of land plots for such purposes, which is also called allocation for construction. In this article, we will discuss in detail the key points of such a procedure, and determine the list of documents.
What land plot can be obtained for construction?

Citizens of Ukraine have the right to receive a land plot for the construction of a residential building, outbuildings and a garage. At the same time, such a free transfer is carried out within the limits of the following norms:
- in villages – up to 0.25 hectares.
- in settlements – up to 0.15 hectares.
- in cities – up to 0.10 hectares.
Important: Real estate located on such land plots must be privately owned or leased from a citizen. This requirement is necessary to fulfill while martial law is in effect in Ukraine.
The procedure for allocating a land plot for construction
What documents need to be prepared?
A number of documents need to be prepared:
- first, an application for permission to develop land management documentation for allocating a land plot for construction (submitted to the state body or local government, in whose department the relevant land is located);
- second, land management documentation for the formation of the land plot, prepared by a certified land surveyor engineer (information about them can be checked in a special state register);
- third, a construction project (or a construction passport for the development of the land plot) with all necessary technical drawings (prepared upon request to a certified construction company);
- fourth, a permit for the construction of new objects of impact class C1-C3 (issued by the State Architectural and Construction Inspectorate);
- finally, documentation confirming the ownership of a residential building, outbuilding or garage located on the relevant land plot.
Important: In case of positive consideration of the application for the allocation of a land plot, permission to develop land management documentation is granted by the decision of the relevant authority. It is this document that plays the most important role in launching the entire process as a whole.
What is the algorithm of actions for obtaining a land plot for construction?
The process of obtaining a land plot for construction in Ukraine includes several sequential steps:
- Submitting an application to the state administration, village, settlement or city council, depending on the location of the land;
- Obtaining a decision on granting permission to develop a land management project;
- Submitting a request for the development of documentation to a business entity that has a license to perform land management works;
- Assigning a cadastral number to the land plot in the State Geocadastre;
- Submission of a land management project to the authority that granted permission for its development, to obtain confirmation of its implementation;
- State registration of ownership of a land plot;
- Submission of an approved project to the local urban planning authority, initiation of the procedure for obtaining a permit to perform construction work.

Assigning a cadastral number to a land plot
A cadastral number is assigned to a land plot for the implementation of many operations, including privatization for development. This procedure is carried out on the basis of an applicant’s request to the state cadastral registrar with all necessary documents. As a general rule, this process can be initiated by a person who, by decision of an executive body or local government body, has been granted permission to develop land management documentation, or his representative by power of attorney.
State registration of rights to land allocated for construction
Finally, the final stage of the official registration of land for a citizen is the state registration of rights to it in the State Register of Real Rights to Real Property (DRRP). For further confirmation of his ownership, a citizen will also receive an extract from the DRRP after entering all the necessary information there by an employee of the Central Administrative Center or a notary.
Cost of allocating a land plot for construction
As a general rule, the price of such a process is not fixed and involves taking into account a number of important factors:
- administrative fee for registration of ownership (as of May 2025, it is 300 hryvnias);
- payment for the services of a land surveyor (depends on the pricing policy of each company);
