Electricity supply license
What is an electricity supply license?
An electricity supply license is a permit that gives a business entity the right to carry out activities related to the supply of electricity to consumers. It is a mandatory document for all participants in the electricity supply market and certifies that the company meets the established requirements and standards, which guarantees the safety and quality of services.
An electricity supply license (hereinafter referred to as LPE) is issued by the National Commission for State Regulation of Energy and Utilities (NCRECU) upon the application and documents of the individual. The procedure for obtaining a license may include both an assessment of the submitted documents and a verification of the material and technical base of the enterprise, personnel qualifications, etc. The main requirements for an electricity supplier to the Ukrainian market are defined in the Licensing Conditions approved by the National Commission for State Regulation of Energy and Utilities in 2017.

Who can supply electricity under a license?
Firstly, an application for a LPE may be submitted by a business entity (legal entity or individual entrepreneur) officially registered in accordance with the current legislation of Ukraine.
Secondly, the applicant must meet a number of technological and organizational requirements in order to be able to continue to conduct licensed activities. Among them, the following should be highlighted:
- ability to ensure information security of systems and data;
- conducting activities exclusively using the means specified in the documents upon receipt of the relevant permit (and if necessary, making changes in accordance with the procedure prescribed by the National Commission for the Regulation of Energy and Power Generation of Ukraine);
- payment of quarterly contributions for the regulation of activities within the specified deadlines;
- functioning of a website with all necessary information for the supply of electricity to target consumers;
- mandatory formation of contracts with consumers that comply with the legislatively established norms of civil and economic legislation;
- supply of electricity at free prices, in compliance with the rules of the retail market;
- taking into account restrictions on the supply of electricity stipulated by the Law of Ukraine “On the Electricity Market”;
- drawing up daily schedules for the management of electricity;
- opening bank current accounts with a special mode of use, etc.
Finally, it is worth highlighting the obligation of a licensed electricity supplier to comply with labor legislation when officially employing employees. You can learn more about this by consulting a labor lawyer at Prikhodko & Partners Law Firm.
What documents are required to obtain a license for electricity supply?
To obtain an LPE, the following documents must be submitted:
- a correctly completed application for receipt (the form of this document must be specified in the Licensing Conditions from the National Commission for the Regulation of Energy and Utilities of Ukraine);
- information on the means of conducting business (list, technological characteristics, etc.);
- documents on the identity of the business manager, in particular regarding his identification (copy of passport, tax number), assurance of the absence of control by residents of the aggressor state.
- other additional documents that may be requested by a state body.
Liability for supplying electricity without a license
Conducting business activities in the electricity sector without the necessary permits can lead to undesirable legal consequences. Thus, according to Article 164 of the Code of Ukraine on Administrative Offenses, the violator may be fined from 17,000 to 85,000 hryvnias, depending on the severity of the violation.
