Reinstatement of preferential treatment
The preferential regime established in the Association Agreement between Ukraine and the EU is aimed at providing the subject of foreign economic activity with preferential conditions for payment of duties and the procedure for importing and exporting goods.
It is also quite often called the “free trade” regime, due to certain features.
In order to achieve the restoration of the preferential regime, businesses need to prove the origin of goods from an EU member state, compliance with the conditions specified in Protocol No. 1 to the Association Agreement, as well as obtain a positive decision of the customs on the application of free trade rules to the transportation of goods.
The concept of preferential treatment
Preferential treatment is essentially a preferential procedure for international trade between Ukraine and the member states of the European Union.
Its main goal is to deepen trade relations between European partners and our country. Success in the application of free trade rules also directly affects the effectiveness of the European integration process. The main issues regarding this regime are contained in Chapter IV of the Association Agreement.
Association Agreement between Ukraine and the EU: what features of the preferential regime does it regulate?
Preferential treatment for countries includes:
- firstly, mutual reduction or complete abolition of import duties on goods in accordance with the Schedules established in Annex I-A to the Agreement (taking into account the principle of most favored-nation rule);
- secondly, a ban on increasing and introducing new duties;
- thirdly, the abolition of export duties and restrictions on the introduction of alternative measures;
- fourthly, the return of overpaid funds for customs payments (after the entity restores this regime for its goods).
How to properly confirm the origin of goods from EU countries to restore preferential treatment?
To restore the free trade regime for the import and export of goods, the declarant must provide the customs authorities with a certificate of origin of goods of the EUR-1 series, which is the key among the entire package of documents.
At the same time, it is worth emphasizing that even if it is available, customs may refuse due to:
- the certificate has expired;
- errors in the content of the document;
- establishing the fact of falsification of the document (in this case, it is also possible to bring to legal responsibility for violation of customs regulations).
To find out how to obtain an EUR-1 certificate and what documents are required for this, we advise you to order a consultation with our customs lawyer.
