Travel abroad of a guardian of an incapacitated person
Due to martial law in Ukraine, introduced in 2022, the state has imposed restrictions on the travel abroad of certain categories of citizens.
However, the legislation also provides for exceptions – in particular, for persons who provide care for incapacitated citizens. Such departure is possible, but requires compliance with a number of legal requirements and formalities.
In this article, we will consider a clear understanding of the legal grounds, requirements, and procedures related to a guardian’s travel abroad with an incapacitated person (for example, for treatment or rehabilitation).
Who is declared incapacitated?
According to the Civil Code of Ukraine, a person is recognized as incapacitated if, as a result of a mental disorder, he is unable to realize the meaning of his actions or control them. Only a court can make such a decision and only on the basis of a forensic psychiatric examination.
After the court decision enters into force, the person is deprived of civil capacity and guardianship is established over him.
Legal status of guardian
A guardian is appointed by the same court decision or by the guardianship and trusteeship body if the decision on incapacity is already in effect.
A guardian is responsible for protecting the rights, interests, and daily care of a ward. Such a person has the right to represent the interests of the ward before all public and private structures.
However, merely being appointed as a guardian does not automatically grant the right to travel abroad – there is a separate procedure for this.
Traveling during martial law: features
Under the legal regime of martial law, most men aged 18–60 cannot leave the territory of Ukraine.
However, guardians of persons recognized as incapacitated have the right to travel with their ward. Such travel is permitted only if the guardian accompanies the incapacitated person who is unable to travel without assistance.
Required documents for crossing the border
Before leaving, you must collect a full package of documents, including:
- Passport of a citizen of Ukraine and a foreign passport (guardian and ward).
- The court’s decision on:
- recognition of a person as incapacitated;
- appointment of a guardian.
- Medical documents, which confirm the condition of the ward (MSEC certificate, Decision of the expert team for the assessment of the daily functioning of the person (EKOPFO).
- Documents about family ties: birth certificate, marriage certificate, extracts from registers.
- Military registration document (for men) and a certificate of deferment from mobilization, if available.
- Documents confirming the consular registration of the person over whom guardianship has been established: if the person is already abroad, this may provide the right to travel without direct guardianship.
Procedure for the guardian
- Check the validity of court decisions — documents must not be canceled or lost.
- Get a certificate from the territorial center for a postponement – apply in person, submit copies of decisions, medical documents, and a certificate of care.
- Prepare notarized copies of documents — border guards may request a copy for verification.
- In case of denial of admission — demand a written reasoned refusal. This will allow you to contact the judicial or law enforcement authorities.
Common mistakes and tips
- Unfinished documents — a common situation is when a guardian performs de facto functions but does not have a court decision.
- Untimely guardianship — even a relative cannot take a person away without a court order, if it is a matter of guardianship.
- Departure without a ward — this is impossible, except in cases of consular registration.
- Documents are not certified — the border service has the right not to accept documents without a seal or certification.
Conclusions
Guardians of incapacitated persons have the right to travel abroad even during martial law — but only under conditions specified by law.
The most important thing is the presence of a valid court decision, a full set of documents, as well as support for the ward.
It is necessary to comply with formalities, obtain all permits and — most importantly — act within the framework of current legislation.
