The most affordable way to obtain a residence permit is through employment. In this way, a long period of stay of a foreigner in the country is ensured legally. At the same time, the list of documents for the State Migration Service must contain a work permit from the employer (permission to use the labor of foreigners or stateless persons).

How is a work permit for foreign citizens issued?

Important! A work permit for foreigners is issued to the employer and not to the foreigner who is applying for a job. This is a document linked to a specific position/positions and a specific period of validity. A document is issued by the State Employment Service (specifically – by the territorial Employment Center).

To obtain a work permit for a foreigner, you must submit:

an application in the form established by the Cabinet of Ministers;

notarized and translated into Ukrainian copies of the passport;

photo of a foreigner or stateless person 3.5 x 4.5 cm;

a copy of the draft labor agreement (contract), certified by the employer.

For your information! Police clearance certificates and medical certificates, as well as a document on education, are not required to be submitted to obtain a permit now. A notarized and translated into Ukrainian copy of the diploma is added to the list of documents only in certain cases.

These documents are submitted to the Employment Center at the location of the employing company. Consideration of the documentation takes seven days, after which a decision is made. The main expense item in this case is the fee for issuing a permit, the amount of which depends on the validity period of the document (from 6 months to 36 months).

What needs to be considered when a work permit for a foreigner is received?

Since a work permit is a justification for obtaining a residence permit, if the work permit is canceled, the residence permit is also canceled. It is important not to allow such a development of events!

The fundamental points in this case:

  • payment by the employer for the permit (within 10 working days from the date of receiving of the decision on the issue);
  • conclusion of an employment agreement (contract) with a foreigner or stateless person no later than 90 calendar days from the date of issue of the permit;
  • timely renewal of the permit (it is allowed to renew the permit for an unlimited number of times);
  • payment by the employer of a salary not lower than the minimum established by law (not less than 10 minimum wages).
