Vindication claim
A vindication claim (hereinafter referred to as vindication) is a classic method of protecting property rights. In the simplest legal language possible, it is a claim from the owner (title holder) to another person who actually owns the property with the aim of returning it. Therefore, this method of protection involves returning the relevant thing in kind, eliminating unfair possession, and compensating for losses, if any. Vindication: What is it?
Vindication is aimed at returning property in good condition from someone else’s illegal possession. It is used when the owner has lost the ability to own, use and dispose of the property. In essence, the owner only has a legal document confirming his rights, but does not have physical access to the relevant object. It is also worth emphasizing that vindication is possible only when there are no contractual relations between the owner and the actual owner. The most typical situation when it is used is when:
- first, the property was sold according to a chain of contracts;
- second, the property was lost, stolen;
- third, the property left the owner’s possession in another way beyond his will.
In what cases is a vindication claim filed with the court?
A vindication claim is filed with the court no later than three years from the moment when the violation became known, and under the following conditions:
- the plaintiff has a legal title (a document establishing title to the property);
- the person does not have actual possession;
- the defendant’s possession is unlawful (without proper legal basis, under an invalid contract);
- the object is an individually defined thing (there cannot be things defined by generic characteristics);
- the absence of contractual relations (even if a contract was concluded, in the event of its invalidity, such relations between the parties are effectively terminated).
What property can be claimed from judicial illegal possession?
Vindication is aimed at the return of only specific property in kind in its original condition. Accordingly, if the thing is destroyed, processed, consumed, it will be impossible to file a vindication claim. Such property must also exist physically, have identifying features, unique characteristics. Items such as grain, money, a batch of stationery, etc. cannot be the subject of a vindication.
What are the features of a vindication claim today?
Modern law and judicial practice significantly expands the circle of those persons who have the right to file a vindication claim. Therefore, the plaintiff may be not only the owner, but also the titular possessor (tenant, mortgagee, etc.). In addition, the key features of the specified method of protecting property rights are the following:
- defendant – any person who actually owns property without legal grounds (or under an invalid business contract);
- both an individual thing and an ideal share of property (0.5) in the right of joint ownership are subject to claim (according to the results of the analysis of the practice of the Supreme Court for 2023);
- if the property needs to be divided between several owners – first, vindication is filed, and only then a claim for division (for example, of a land plot).
