Redevelopment and reconstruction: what is the difference?
Very often, the terms “redevelopment” and “reconstruction” are confused. However, where are the different concepts.
Redevelopment of the apartment involves changing the dimensions of the housing in accordance with the project documentation. In the process of redevelopment, it is allowed to demolish or move partitions in the house, add new elements, etc. The exception is load-bearing structures. In turn, reconstruction is a more radical process. It is not only more difficult to perform. It requires many more permits. Reconstruction of the house involves direct intervention in the geometric parameters of the residence. As a result, its functional purpose changes.
The Law of Ukraine allows the following redevelopment options:
- Increasing the area of the room through auxiliary rooms and corridors.
- Dismantling pantries, mezzanines, built-in cabinets.
- Moving the entrance door to the apartment.
- Holes in retaining partitions.
- Combining two rooms (if they are not retaining structures).
Important: when changing the layout of housing in a high-rise building, it is not necessary to apply for permission from the regulatory authorities. According to the current Ukrainian legislation, Ukrainians have many opportunities for redevelopment of apartments. If you do not plan to involve general purpose communication systems or capital structures, a permit is not required.
Apartment planning allows:
- Moving, demolishing, erecting are not capital walls.
- Combine the bathroom (in cases where it is not separated by a capital wall).
- Create new balcony or window openings.
- Combine the kitchen with the balcony.
Peculiarities of legalization of redevelopment
Before legalizing redevelopment in a house or apartment, it is worth determining whether the load-bearing walls will be disturbed during the repair process. This is due to the fact that in the process of intervention in engineering networks and load-bearing walls, not only re-planning is carried out, but also reconstruction. That is why permission for its implementation must be obtained even before the start of construction work.
As for the redevelopment procedure, it is simplified compared to reconstruction. A new technical passport is enough to agree on the work done. It will show the main characteristics and layout of the apartment after all the work is done.
A new technical passport for the premises is sufficient in cases where the ratio of living space and total area remains unchanged. In other cases, you must obtain a new technical passport and contact representatives of the State Register of Property Rights.
Important: if redevelopment is carried out, it is necessary to obtain the consent of all co-owners of the apartment.
Documents required for legalization of redevelopment:
- Redevelopment project.
- Technical and author supervision.
- Declaration on the start of construction works.
- Technical passport.
- Declaration on the readiness of putting the house/apartment into operation.
- Registration. For the final legalization of the redevelopment of the apartment, the owner must obtain a Certificate of Ownership.
