REPORT FOR DISMISSAL FOR CONTRACTORS
Military service in Ukraine is a way for a citizen to serve his country and gain valuable skills, experience and monetary rewards. Contract military service is one of the options for those who independently expressed a desire to serve in the Armed Forces of Ukraine.
Today we will consider the issue of dismissal from military service, for those who perform this duty under a contract during martial law.
The conditions for the dismissal of contract servicemen are somewhat different from those called up for military service during mobilization during the period of martial law on the territory of Ukraine. These provisions are detailed in Part 5 of Article 26 of the Law of Ukraine “On Military Duty and Military Service”.
Thus, the analysis of the Ukrainian legislation on military service allows us to say that today the military under the contract is legally more limited in terms of grounds for dismissal than the mobilized.
It is also necessary to note that the grounds for dismissal in peacetime and during martial law in the country also differ. Since in peacetime contract servicemen can be dismissed from military service after the expiration of the contract period. This means that they are expected to fulfill their contractual obligations and fulfill their obligations until the end of the contract. However, during martial law, unfortunately, such a ground for dismissal is not provided due to the fact that the contract is automatically renewed.
Some reasons for terminating a contract
- One of the reasons why a contract can be terminated is for health reasons.
That is, if a soldier becomes unfit for military service with an exception from military registration for health reasons, the contract may be terminated. To do this, the report must describe the state of health, indicate the conclusion (decree) of the military medical commission, which will need to be added to the report.
- Another reason is the need for constant care for a person in need of care.
Unlike the mobilized, if a contract soldier has a wife with a disability or he has one of the parents or parents of one of the disabled spouses of group I or II, he will not be able to quit.
However, in this case, contracted servicemen can provide permanent assistance in caring for a person with a disability of group I or II or a person recognized in the conclusion of a medical and social expert commission (or a medical advisory commission of a healthcare institution) in need of a permanent stranger. care. To do this, the report must indicate who the serviceman is caring for and indicate why he should carry it out and add documents confirming the fact of such care.
Can you quit on your own?
Only military personnel from among foreigners and stateless persons who are serving under a contract in the Armed Forces of Ukraine can resign at their own request.
What should be included in the report?
The main purpose of writing a report is to describe the circumstances due to which the soldier wants to quit. Therefore, the report must necessarily contain the justification of the grounds, confirmed by the relevant notarized documents. Such work should be carried out with special attention and responsibility or entrusted to a specialized lawyer.
