Extract from the land registry about the land plot
To carry out various transactions with real estate, you will definitely need an Extract from the State Land Cadastre (hereinafter referred to as the SLC). We are talking about such transactions as the sale or purchase, exchange, donation, inheritance, etc. This document is a confirmation that the land plot has been registered in the Land Cadastre, with the assignment of the appropriate number and detailed information about the encumbrances, restrictions that are recorded in the Land Book. In this article, we will consider how to obtain an extract from the SLC about a land plot.
Why might an Extract from the State Land Registry be needed?
As practice shows, in most cases, obtaining an extract from the cadastre may be necessary in the following cases:
- In the process of legalizing a land plot, that is, during the assignment of a cadastral number.
- When implementing operations related to land.
Let’s consider each case in more detail. Obtaining a cadastral number will be necessary for owners of land plots who have a State Act – confirmation of ownership of the land. At the same time, this data has not yet been entered into the State Land Registry for some reason.
Thus, the land owner, if there is a state act, must submit a package of documents to the state cadastral registrar at the location of the real estate to enter the relevant information into the cadastre. The extract will be confirmation that the data about the land plot has been entered into the register.
The exception is state acts issued before 2004 (these acts do not have a cadastral number). In this case, additional development of technical documentation and organization of assignment of a cadastral number will be required. That is, the procedure is complicated by several additional steps.
An extract may also be required to carry out transactions with a land plot (exchange, donation, purchase and sale). In addition to information on the registration of a land plot, the extract may contain information on the regulatory monetary assessment and restrictions on the use of real estate. If previously the specified information was indicated in the form of separate certificates, now it is contained in a single document.
Features of the formation and validity period of an extract from the State Land Cadastre
As mentioned above, one of the main documents that a notary or representatives of other structures will need in the process of preparing a purchase and sale agreement, exchange, donation, is an extract from the State Land Cadastre. It is this document that confirms that the relevant data has been entered into the State Register of Real Property Rights.
You can independently go through all the stages for using an extract from the State Land Cadastre through the Center for Providing Administrative Services or through the online services of the State Land Cadastre (we are talking about the “Public Cadastral Map”). However, for this you need to have complete information about the land plot, its previous owners, etc. It is quite difficult to search for such information individually. The procedure for issuing this document is regulated at the legislative level, namely by the Law of Ukraine “On the State Land Cadastre”. To obtain an extract, you must submit an application in the prescribed form and pay the state fee.
In addition to the application, the following documents must be provided:
- State act.
- Extract from the RRP (Register of Real Rights).
- Certificate of establishment of ownership.
- Real estate lease agreement (if land use is based on a lease agreement).
- Personal documents of the owner – copies of passport and TIN.
- Notarized power of attorney (if the extract is requested by a person other than the owner of the land plot).
The Resolution of the Cabinet of Ministers of Ukraine “On Approval of the Procedure for Maintaining the State Land Cadastre” states that the validity period of the extract is three months from the date of its issuance (paragraph 178 of the Resolution). However, there are exceptions to this rule. The following are permanent:
- Extract, which is provided for registration of ownership of inheritance (this document is issued to heirs).
- An extract, which is a confirmation of state registration of a land plot.
Important: establishing ownership of a land plot requires official registration within 12 months after receiving the extract. In the database, the extract is formed in pdf format, that is, in the form of an electronic document. The legislation does not provide for the presence of a seal and signatures on the extract. Each extract is verified using a QR code (it is indicated on each page of the document).
