Obtain a permit for construction and reconstruction of real estate

Today, one of the ways to improve housing conditions in Ukraine and change the existing configuration is reconstruction. The reconstruction involves large-scale construction and repair works. According to the current Ukrainian legislation, the reconstruction of the real estate object requires the mandatory obtaining of a permit from the state authorities. Peculiarities of permit documents for the start of construction and reconstruction

Reconstruction belongs to the group of repair and construction works. Any reconstruction involves changes in the area of the building, engineering parameters, number of floors, etc. Also, such changes may involve interference with the supporting structures of the building itself, the roof, facade, and entrance groups. In addition, walls and internal partitions are often re-planned.

Thus, during reconstruction, very often:

1. The area of the real estate object changes (increases or decreases).
2. Changes are made to engineering systems.
3. The functional purpose of the premises/building is changing.
4. The premises are being dismantled or completed.
5. The dimensions of the building are changing.

The list of permit documents for reconstruction depends on the specific case, type of building. The following documents are most often used:

1. Permit document for the start of construction. This document cannot be dispensed with for the commissioning of objects whose compliance class is SS2 and SS3.
2. Issuance of a notice on the start of the construction process — for such real estate objects as houses, apartments, garages, etc., which have a responsibility class of СС1.

A permit for reconstruction is required in cases where direct intervention in the basic structures and elements of the real estate object’s enclosure is foreseen. It may also refer to changes in the geometric dimensions of premises or buildings. According to Cabinet of Ministers Resolution No. 406, permits are not required for the following works:

1. Repair works that are not accompanied by interference with load-bearing structures.
2. Works that involve the restoration of structures or buildings after emergency situations.
3. If it is planned to erect a temporary structure or building after accidents.

Thus, it is not necessary to obtain permission in the above cases.

Documents required to start construction

First you will need to get the raw data. The procedure for obtaining them is regulated by Articles 29-30 of the Law, as well as by the relevant Provisions of Order No. 289 of the Ministry of Regional Development, Construction and Housing and Communal Services of Ukraine.

In addition, it will be necessary to develop project documentation for the start of construction. If there is such a need, it should be additionally examined. The next stage is the approval of the specified documentation.
