Renewal of the birth certificate

Very often, in practice, there are problems in claiming certificates or extracts from the bodies of DRATS, because when a citizen applies in person, it turns out that the act record is missing for a specific certificate, for example, about birth, and it cannot be obtained.

In such a case, the legislator provided the only mechanism that helps to obtain this document – it is the renewal of the deed record.

However, not every citizen knows how to implement this procedure in practice. What is the relevance of the chosen topic for today.

Therefore, in this article we will talk about the renewal of the act record of birth, taking into account the provisions of the current legislation of Ukraine.

What entitles a citizen to renew the act record of civil status?

The main basis for accepting a written application for the renewal of the act record of civil status by the DRATS authorities is an extract from the State Register of Acts of Civil Status of Citizens, in which it is stated that the relevant act record is missing, that is, it was lost.

Suppose these data were transferred to the state archive for storage because a significant period of time has passed. In that case, only an archival certificate about the absence of this document will give the citizen the right to renew the act record of civil status.

Where should I apply for renewal of the act record of civil status?

Such an application for the renewal of a lost act record of civil status is submitted in the prescribed format and form to the territorial bodies of the State Civil Registry Office at the permanent place of residence or stay of the applicant.

When applying, you need to confirm your identity with the help of passport documents.

If individuals live on the TOT or have moved from it to another permanent residence, then in this case, the territorial jurisdiction of applying does not apply, since these citizens have the right to apply to any bodies of the DRATS at their discretion.

If citizens of Ukraine live permanently outside the country, then the application is submitted to the diplomatic mission or consular institution of Ukraine, because during the period of martial law in the country, they are empowered to renew the relevant acts of civil status.

Who has the right to apply for renewal of the act record of civil status?

citizens, in respect of whom the act record was drawn up and it has legal significance for them;
father or mother of a minor;
guardian of a minor;
the guardian of a minor or an incapacitated person;
legal heirs of a deceased citizen;
a representative of the body of guardianship and guardianship, if he applies to the interests of the person over whom he exercises guardianship or guardianship.

Importantly! This list is incomplete and may be expanded depending on the individual circumstances of each case.

What list of documents must be submitted together with the application for renewing the act record of civil status?

A certificate from the archival department is necessary in a situation when it is impossible to obtain an extract about the absence of an acting record in the state register;
evidence that provides relevant and complete information for renewal of the deed record;
a certificate of state registration of acts of civil status certifying the facts that are important for the applicant;
other evidence and documents confirm the applicant’s right to consider his application.

It is worth noting that obtaining a positive decision regarding the renewal of the deed record is possible only when there is evidence that the corresponding deed record was previously drawn up in the DRATS bodies (for example, certificates of registration of such acts, their copies that can be notarized, the presence stamps or other marks on registration of the act in the citizen’s passport, etc.).

What are the deadlines for considering the application?

The total term during which the DRATS bodies must consider the application for the renewal of the act record is no more than 90 days from the moment of submission of the relevant documents for their consideration.
