State Property Privatization Procedure: Legal Regulation

- Attracting investments (both domestic and foreign).
- Reducing the percentage ratio of state and private property in the structure of the Ukrainian economy in favor of the latter.
You can familiarize yourself with the privatization procedure – the basic features are specified in the Law of Ukraine “On Privatization of State and Communal Property”. However, if you have never been involved in a particular role in the privatization procedure, it is quite difficult to monitor the implementation of all the requirements of the Law and successfully go through all the stages of privatization.
Among the possible difficulties is the State Property Fund making unfounded decisions. For example, a person may be denied admission to participate in a privatization auction. There are frequent cases when, based on the results of the auction, the privatization body refuses to recognize a person as the winner of the auction. Sometimes other participants in the privatization process may challenge the state property purchase and sale agreement in court. As practice shows, state property may be included in the list of objects subject to privatization by mistake or in violation of current legislation.
Let us consider the features of the procedure using the example of the sale of small-scale privatization objects. The auction commission, which makes a decision on privatization, consists of at least five people. It is this commission that is engaged in the development of the conditions of sale, as subsequently approved by the privatization authority. Within ten days, a corresponding information notice regarding the start of privatization is published on official resources, in particular, in the electronic trading system ProZorro. The protocol with the results of the procedure is published on the day of the auction. If the winner refuses to sign the protocol or conclude a purchase and sale agreement, a new protocol is automatically published. As a result of the refusal, the auction winner loses the right to re-apply for the same real estate object.
