PROTECTION OF THE RIGHTS OF FOREIGN CITIZENS IN UKRAINE

Despite the fact that a full-scale war is going on in Ukraine, our state has become a comfortable place to stay for many foreign citizens. Someone got married here, someone became an investor or opened a business, someone entered a Ukrainian university, and someone himself is in the status of a refugee or a person who requires additional or temporary protection. In short, there can be many options. The team of the “Prikhodko&Partners” law office has experience in consulting and legal support of various categories of cases related to the protection of the rights of foreigners in Ukraine. We invite you to familiarize yourself with the key areas of our work in such matters.

What statuses can foreigners have on the territory of Ukraine?

If it is not about temporary visits in the format of a tourist trip, but about residence, then it can be about different statuses of a foreigner. For example, he can be a refugee, a person who needs additional or temporary protection.

When we talk about a refugee, we are talking about a person who has fears of unjustified persecution or discrimination, as well as physical danger in their previous place of residence. There is a convention on the status of refugees from 1951, to which our state has joined. There is also the 1967 Protocol Relating to the Status of Refugees and national legislation governing the matter.

When it comes to a person in need of additional protection, this status is also obtained due to the impossibility of returning to one’s country, given the danger to life and health or the direct risk of persecution, torture, or the death penalty. As for persons in need of temporary protection, we are talking about those who were forced to flee to Ukraine as a result of external aggression, civil war, natural disaster or other event that violates the usual public order.

Recognition as a refugee or a person in need of additional or temporary protection takes place through the State Migration Service. Currently, when Ukraine is under martial law, this option is suspended. However, those people who already have a similar status often need support in various legal matters. So we can help them.

Temporary and permanent residence permit

Such a basis for living in Ukraine is more realistic for foreigners today. In this context, we can help in the following ways:

  • advise and answer your urgent questions, explaining the optimal algorithm of actions;
  • to provide legal support in interaction with the Social Security Administration, so that you do not suffer from overload or bureaucratic processes in this structure.

We will explain all the legal grounds for obtaining a temporary or permanent residence permit and help choose the optimal strategy to achieve the result.

Exit from Russian citizenship

According to the data of the Ministry of Internal Affairs, almost six months after the full-scale Russian invasion, about 175,000 people with Russian passports lived in Ukraine. For a long time, many people have no mental connection with the aggressor country, so a natural question arises regarding the renunciation of its citizenship. The problem is that Russian diplomatic missions in Ukraine do not work, and it can be dangerous for a person with an anti-war position to return there to resolve issues. However, our lawyers help in this situation. There is a well-developed algorithm on how to legally oblige the State Migration Service to accept a foreigner’s declaration of renunciation of Russian citizenship. However, the process lasts about a year, so you should not delay in applying.

Summing up, it should be noted that our specialists have good experience in legal support of cases related to various aspects of the protection of the rights of foreigners. So we’ll put all our knowledge and experience to help you.
