The Law of Ukraine “On Public Procurement” stipulates that a participant’s arrears in the payment of taxes and fees (mandatory payments) is grounds for refusal to participate in the procurement procedure. In order to confirm the absence of such arrears, the participant must obtain a confirmation from the supervisory body in the form of a Certificate on the absence of payment arrears, the control of which is entrusted to the supervisory authorities (hereinafter referred to as the Certificate).

In addition, the analysis of the Decisions of the Antimonopoly Committee of Ukraine on complaints against the Customers showed that the demands of the Customers, which are the need to provide the Certificate, are legitimate, and the participant who does not provide such a Certificate is reasonably considered to have failed to fulfill the conditions of the tender documentation. As a result, the opportunity to conclude a contract with the Customer on rather formal grounds was missed.

Therefore, the formality of the Customer’s requirements regarding the provision of the Certificate does not mean that they are groundless. This is one of the control procedures that helps the Customer to ensure the reliability and stability of the partner for the conclusion of the contract. Therefore, participants must be ready to meet such requirements and provide adequate documentary support for their tender offer.

Attention! The term of validity of such certificate is 10 calendar days from the date of its formation. The Certificate must specify its validity period.
