The Law of Ukraine “On Public Procurement” stipulates that a participant’s arrears in the payment of taxes and fees (mandatory payments) is grounds for refusal to participate in the procurement procedure. As a result, the opportunity to conclude a contract with the Customer on rather formal grounds was missed.
Therefore, the formality of the Customer’s requirements regarding the provision of the Certificate does not mean that they are groundless. This is one of the control procedures that helps the Customer to ensure the reliability and stability of the partner for the conclusion of the contract. Therefore, participants must be ready to meet such requirements and provide adequate documentary support for their tender offer.
