Privatization of a garage in a garage cooperative
Garage privatization is a legal procedure for registering ownership of a garage box, which is completed by registering this right in the State Register of Real Property Rights to Real Estate (SRPR). In essence, this is the transformation of the right of use into a full-fledged private property right. Garage box privatization is usually a simple procedure. What is a garage cooperative?
A garage cooperative is a voluntary association of citizens created for the construction and operation of garages. It operates on the basis of the Charter, which, among other things, stipulates the procedure for using the common property of members. A key aspect of a garage cooperative is the issue of establishing collective ownership, which extends to land plots and garage boxes. In general, while you are a member of a garage cooperative, you own a share in all the property of the cooperative in proportion to your share contribution.
Who can privatize a garage in a garage cooperative?
The right to privatize a garage is acquired by a member of a garage cooperative, provided that he:
- firstly, has fully paid his share contribution;
- secondly, is a valid member of this legal entity at the time of privatization.
Important! The right to privatization also directly follows from the provisions of the Statute of the cooperative. In this case, the association must have official registration and not be in the process of termination. The procedure for privatizing a garage in a garage cooperative: what documents are needed?
For proper registration, it is necessary to collect the following documents:
- a copy of the passport of a citizen of Ukraine;
- a certificate of membership in a garage cooperative;
- copies of documents for the land under the garage;
- a technical passport for the garage (can be ordered from a certified engineer at the BTI);
- other documents at the request of the state administration.
Registration of ownership of a garage in a garage cooperative: conditions and algorithm of actions
For successful registration, it is necessary to document the legality of the construction of garages, their commissioning, and the real right to the land plot. Finally, it is also important that the garage complex or individual garage boxes are assigned a postal address as an object of real estate.
Then, the following documentation must be submitted to the ASNAP or local notary:
- documents for the applicant’s identity (passport, identification code);
- technical passport for the garage;
- document on the acceptance of the garage into operation (if it was built after 05.08.1992 and does not fall under the definition of a temporary structure);
- a document confirming the assignment of an address to real estate;
- a document confirming the status of the land plot (certified copy of an extract from the State Land Registry);
- a statement on the implementation of relevant registration actions.
State registration of ownership is carried out within a period not exceeding five working days from the date of submission of the application. An administrative fee of 0.1 subsistence minimum (approximately 303 hryvnias as of June 2025) is also charged for it. The result of a successfully completed privatization procedure is receiving an extract from the State Register of Real Property Rights to Real Estate (SRPR).
