Accompanying a person who needs constant care abroad
Crossing the border during martial law for people who need constant care is a difficult but manageable procedure.
Ukrainian legislation establishes clear rules for this category of citizens, which are based on Resolutions of the Cabinet of Ministers of Ukraine No. 57 and No. 1044.
In this article, we will analyze the key aspects of the process and explain how our lawyers can help you successfully resolve this matter.

Who has the right to cross the border during martial law?
According to the Resolution of the Cabinet of Ministers of Ukraine No. 57, the right to cross during martial law borders have, in particular:
- Persons with disabilities: in the presence of relevant supporting documents, such as a certificate of inspection by the medical and social expert commission (MSEK) or a certificate confirming the status of a person with a disability.
- Persons who provide permanent care for persons with disabilities of group I or II: on the condition of providing documents confirming the fact of providing care.
- Family members of the first degree of kinship who accompany persons in need of constant care: parents, husband or wife, children, including adopted children.
Peculiarities of border crossing for accompanying persons
Accompanying persons should consider the following aspects:
- Physical presence of the person in need of care: crossing the border is possible only under the condition of joint departure with the person in need of care. Independent departure of the accompanying person without a ward is not allowed.
- Obligation to return: the accompanying person is obliged to return to Ukraine no later than the return of the person she accompanied. Although liability for violation of this requirement is not currently prescribed by law, compliance with this rule is recommended.
The main stages of the procedure:
- Obtaining the opinion of the medical and advisory commission (MAC)
The conclusion confirms that the person needs constant care.
- Issuance of an act establishing the fact of care
This document is drawn up by the social security authority on the basis of your request. It is key to confirming the right to accompany a person abroad.
- Collection of supporting documents
Certificates confirming a person’s disability or state of health.
Documents confirming family ties (birth certificates, marriage certificates, etc.).
- Border crossing
Having collected all the necessary documents, you can cross the border together with the person who needs care.
