Privatization of land: who has the right
During the war, the possibility of privatizing land for individual citizens remains. Such persons must complete all necessary actions and collect documents for the privatization of the land plot (share) by 2028, in accordance with the decision of the Verkhovna Rada of Ukraine. Otherwise, it will be considered that citizens have refused free privatization of land, in particular, that which is located under real estate objects that are in their ownership.
According to the current law, citizens of Ukraine who:
- have personal ownership of houses, garages and other structures located on a non-privatized land plot (with appropriate restrictions on the possible area of land for privatization – 0.01 ha (garage), 0.10-0.25 ha (residential house/cottage), 0.12 ha (garden building)) have the right to privatization;
- received land from the state from communal property for use until January 1, 2002;
- express a desire to register ownership rights to the land plot that is allowed to be privatized (for example, land plots of the nature reserve fund, under state railways, separate modes of transport, etc. are not subject to privatization according to the laws of Ukraine);
- have state acts of ownership of the corresponding land shares of pink, green or blue color (issued from 1991 to 2012, respectively) – in this case, it will be sufficient to carry out the general procedure for registering private property.
Often there are situations when several people – co-owners – privatize a land plot. For example, one of the spouses, who at the same time have the right to joint ownership of the house, has the right to receive free ownership of a land share under a summer house. In this case, land privatization is possible in proportion to their shares in the real estate object.
List of documents for successful land privatization
To avoid the risks of a possible refusal by state bodies to privatize land and to speed up the process itself, it is important to prepare the correct list of documents. The necessary documentation for this is:
- passport for identification of the owner (co-owners) and tax identification code;
- application for land privatization with attachments: a document confirming the right to use the land, ownership of real estate (for example, an extract from the State Register of Real Estate Rights);
- technical documentation for the land plot;
- other title documents that may be required by the controlling authority (share certificate, extract on the distribution of land shares) and others.
