License for the production of electricity
When do you need to obtain a license to produce electricity?
A license for the production of electricity (hereinafter referred to as LPE) is an official document issued by the National Commission for the Regulation on the Regulation on the Production of Electricity (NCRECP) at the request of a legal entity or an individual enterprise whose purpose is to produce electricity for offering to consumers on the market (including alternative energy sources).
According to the Licensing Conditions approved by the National Commission for the Production of Electricity, electricity producers are required to obtain a license if the total capacity of their equipment exceeds 5 MW (at one site) and 20 MW (total at all sites). This requirement does not apply only to persons who produce energy from alternative sources. In other words, if the production of such electricity is subject to stimulation by a “green tariff” (for example, from solar panels), it is mandatory to obtain a license, even if the total capacity is less than 5 MW, established by law.
LPE is also not mandatory in cases where: electricity is produced for the person’s own needs, without its further sale; electricity is produced by a mobile installation during martial law. In all other cases, the person is obliged to obtain the appropriate permit documentation.

What documents are required to obtain a license for electricity production?
In order to obtain a LVE, the manufacturer must provide the following documents:
- application for obtaining such a permit (in accordance with the form specified in the Appendix to the current License Terms);
- copies of title documents confirming the right of ownership or use of generating installations, premises where it is planned to be produced (for example, a lease agreement with a mandatory indication of technical characteristics; a purchase and sale agreement, specification or invoice);
- copies of documents confirming the succession of rights to pay for energy carriers and services (does not apply to producers at a “green” tariff, i.e. those who use alternative sources of electricity);
- technical documentation of passports for production equipment, where its capacity is clearly indicated (most often this is a technical passport);
- clearly formed schemes for connecting to the network with an indication of metering devices (for this it is necessary to obtain design documentation for the installation and production);
- a copy of a document on the readiness of the facility for operation (for example, a relevant certificate issued by a regulatory authority in the field of construction and real estate);
- confirming information regarding the absence of ties with the aggressor state.
The most common reason for refusal to issue a LVE is improper preparation of documents or inconsistency of the information in them with the submitted application. Therefore, it is important to contact experienced specialists for legal assistance in this matter to be sure of successful obtaining a license.
