LAWYER’S REQUEST FOR RECEIVING INFORMATION ON THE COMPLETION OF MILITARY SERVICE

Among military personnel, there are situations when it is necessary to find out one or another information regarding issues directly related to their military service.

It is worth noting that failure to respond to a lawyer’s request entails administrative liability, therefore ignoring such a request is more often an exception in these statistics.

The legislation says the following. The state power body, local self-government body, their officials and employees, managers of enterprises, institutions, organizations, public associations, to which the lawyer’s request was sent, are obliged to provide the lawyer with relevant information no later than five working days from the day of receiving the request, copies of documents, except for information with restricted access and copies of documents containing information with restricted access.

If the lawyer’s request concerns the provision of a significant amount of information or requires the search for information among a significant amount of data, the term of consideration of the lawyer’s request may be extended up to twenty working days with justification of the reasons for such extension, which shall be notified to the lawyer in writing no later than five working days from the date receiving a lawyer’s request.

Thus, providing a response to a lawyer’s request is mandatory and only thanks to the information received in response, there is an opportunity to protect one’s violated rights and interests, or to prevent such violations.

Therefore, we advise you to be extremely responsible when choosing a lawyer, even in such a matter as submitting a lawyer’s request.

In most cases, the information provided in response to a lawyer’s request has to be analyzed additionally, since the persons in whose interests such information is requested are mainly presented in legal terminology and may be incomprehensible to a person without appropriate education.
