The Unified State Register of Court Decisions (hereinafter – USR) ensures proper storage and provision of copies of all court decisions on the territory of Ukraine. All procedural documents adopted by courts during the consideration of cases in civil, administrative, commercial or criminal proceedings are entered into the specified database. At the same time, it is worth emphasizing that since the beginning of martial law, the issue of full or partial restriction of public access to it has been considered. Information from the register of court decisions: what data can (not) be disclosed?
Despite the fact that court decisions are open and subject to publication, the legislation of Ukraine establishes clear mechanisms for protecting certain information (in particular, personal data of participants). Using the register of court decisions during martial law: what restrictions are proposed?
The decision to restrict access to the EDRSSR during martial law is motivated by two main goals: security and data protection. The restrictions should be aimed at minimizing the risks associated with military aggression and provide for the prevention of threats to life and health (in particular, military personnel), ensuring the security and integrity of the database. Prohibition of disclosure of information about critical infrastructure
The draft law No. 7033-d proposes to grant courts the right not to publish in public access information that may contribute to the identification of critical infrastructure institutions. Prohibition of publication of decisions concerning military facilities and military
The proposed restrictions concern the prevention of disclosure of information constituting a state or military secret.
