Guardianship over parents as a basis for postponement
Under martial law, the legislation of Ukraine provides for a number of legal mechanisms that allow persons liable for military service to receive a deferment from mobilization.
One of these grounds is the establishment of guardianship over parents.
Unlike other forms of social support, guardianship is established exclusively in court, which gives this status a special evidentiary value.
Legal essence of guardianship
Guardianship is a form of legal protection of an adult who, due to mental state or other circumstances, cannot realize the significance of his actions and manage them.
The establishment of guardianship is possible only after the person is recognized as incapacitated in court. Accordingly, without a court decision on the incapacity of the father or mother, guardianship as a legal institution does not arise.
That is why guardianship differs significantly from other grounds for deferral: it is based not on factual circumstances, but on a judicially established status, which is confirmed by a court decision and the relevant registration actions of the guardianship and guardianship authorities.
Judicial procedure for establishing guardianship
The procedure for establishing parental custody consists of several stages.
- The first step is to apply to the court with an application for recognition of a person as incapable. The application is accompanied by medical documents confirming the presence of a persistent mental disorder, which makes it impossible to independently exercise civil rights and obligations.
- As part of the trial, a forensic psychiatric examination is mandatory. It is its conclusion that is crucial for the court when making a decision. If the application is satisfied, the court recognizes the person as incapacitated and establishes guardianship over him.
- After the decision comes into force, the guardianship and guardianship authority appoints a specific person as a guardian. As a rule, preference is given to close relatives, in particular children of an incapacitated person, provided that they comply with the requirements of the law.
Guardianship as a ground for deferment
The presence of the status of a guardian is confirmed by a court decision. It is this document that is the main one when submitting to the territorial center for recruitment and social support to exercise the right to a deferment from mobilization.
It is important that in this case, the very fact of the need for care does not require additional proof, since it has already been established by the court within the framework of the case of incapacity.
Thus, guardianship is one of the most legally stable grounds for deferral, since it is based on a judicial act that is mandatory for all public authorities.
Practical difficulties and risks
At the same time, the procedure for establishing guardianship is complex and lengthy. Trial, examination, participation of guardianship and guardianship authorities require time and professional training.
In addition, the courts carefully check the validity of the statements, since the recognition of a person as incapacitated significantly restricts his civil rights.
That is why any formal errors in the documents or insufficient evidence base may lead to a refusal to satisfy the application.
Importance of Legal Aid
Legal support in cases of establishing guardianship is of key importance.
The lawyer ensures the correct preparation of procedural documents, interaction with medical institutions and guardianship authorities, and also represents the interests of the applicant in court.
This significantly increases the chances of a positive outcome and shortens the time for consideration of the case.
Conclusion
Guardianship of parents, established through the court, is a legal and legally justified basis for obtaining a deferment from mobilization. At the same time, the implementation of this mechanism requires strict adherence to the judicial procedure and a professional legal approach.
