Who can obtain a license for international transportation?
Licensing conditions for international passenger and cargo transportation by road is the main document designed to regulate the licensing procedure for the relevant activity. It defines, firstly, the types of activities that are subject to licensing, secondly, the requirements for recipients of the relevant permits (drivers), and thirdly, the obligations imposed on drivers from the moment of receiving the relevant permit.
So who can obtain a license for international transportation (hereinafter referred to as the LMP)? Having examined in more detail the provisions of the currently valid Licensing Conditions, the lawyer of “Prikhodko & Partners” emphasizes that such entities are:
- legal entities and individual entrepreneurs (FOPs) registered in accordance with current national legislation and officially engaged in the transportation of passengers and goods by road (KVED 49.31, 49.39, 49.4);
- persons specified in the first paragraph, who carry out international transportation of passengers by taxi, on order, by passenger and freight road transport, buses, dangerous goods and hazardous waste;
- drivers with relevant work experience (at least three years), vehicles (cars must meet safety requirements and environmental standards), documents (registration documents for transport, insurance), financial capacity (expressed in the ability to maintain vehicles and meet financial obligations in case of violations of the requirements of laws on LMP).

Other, more specialized requirements for drivers include, first, obtaining a driver’s license of the appropriate category (“D”-“B”), reaching a certain age (for some types of activity – 18 years, for others – at least 21 years), having a special training certificate (for example, for the transportation of dangerous goods). A carrier who has received the appropriate license is responsible for the safety of passengers and cargo during transportation, must systematically send vehicles for technical inspection, and conclude contracts for the provision of transport services with passengers for proper regulation of legal relations.
Obtaining a license for international transportation

- application for a license in the form approved by the License Terms;
- information on the material and technical base, contracts for the performance of technological operations;
- data on vehicles and official documents on them, copies of their registration certificates, temporary registration cards (if necessary);
- information on special equipment for transporting passengers (in accordance with Appendix 4 of the License Terms);
- information on the qualifications of the driver and personnel, if it is a question of transportation by transport companies registered in accordance with the law (Appendix 5 of the License Terms);
- other documentation that will be needed and requested by the licensing authority when considering the application for a license itself.

Responsibility for carrying out international transportation without a license
Carrying out international transportation activities by a business entity without obtaining a license is strictly prohibited and punishable by significant fines under the administrative legislation of Ukraine: from 17,000 UAH to 34,000 UAH (for the first violation). The penalty may also include confiscation of vehicles and profits received as a result of conducting such activities without a license.
