Registration of ownership of a cooperative apartment
A person’s right to a real estate object arises from the moment of its state registration. Only after the registration of a new owner can any legally significant actions be carried out with respect to the apartment, namely – to sell, donate, bequeath, lease, etc. The article is designed to determine the main features of the procedure for registering ownership of a cooperative apartment, examine the list of necessary documents and describe the step-by-step procedure for such registration in Kyiv and Kyiv regions.
Who can register ownership of a cooperative apartment?

The primary owner of a cooperative apartment is the cooperative itself as a legal entity. If desired, members of the cooperative can initiate the procedure for its re-registration. In accordance with current national legislation, the following may become new owners:
- a member of the cooperative – by paying a share contribution;
- the second spouse – on the basis of joint ownership of the apartment on a par with a member of the cooperative;
- a relative of a member of the cooperative who lives with him and has reached the age of eighteen – provided that this is provided for by the Charter of the cooperative and by decision of the general meeting.
Procedure for registering ownership of a cooperative apartment
What documents need to be prepared?
Registration of ownership of a cooperative apartment requires the preparation of:
- documents from the chairman of the board of the housing and construction cooperative (order to move into the apartment, certificates of membership in the cooperative and full payment of the share contribution);
- BTI certificates for real estate (technical passports for real estate);
- documents for registration of ownership of a cooperative apartment put into operation before 01.01.2013.
Regarding the last point, certain difficulties may arise, since the state registrar may require documents confirming the construction and commissioning of the facility, issued according to the old version of the Law of Ukraine No. 1952-IV. For certainty in the collected documents and to avoid unnecessary problems, we recommend contacting one of our real estate lawyers, who constantly monitor changes in national legislation.
Step-by-step procedure
After receiving the necessary package of documents, the next steps will be:
- submitting a request to the state registrar (notary, ASN) with all the necessary documents, including a duly certified copy of the document certifying the identity of the future owner, a power of attorney for his representative (if necessary);
- paying the administrative fee for registering the ownership right. It is worth noting that there are cases of exemption of certain categories of citizens from the mandatory payment of such state duty, primarily victims of the Chernobyl disaster, persons with disabilities of groups I and II, etc.;
- receiving confirmation of successful registration from the state registrar. After successful completion of the procedure for state registration of ownership of a cooperative apartment, the owner receives an extract from the State Register of Real Rights to Real Property, which is an official confirmation of the registered right.
Cases of refusal to register ownership of a cooperative apartment
There are cases when the state registrar may refuse to register the ownership right. It is worth noting that such a refusal must be, firstly, justified, and secondly, comply with current national legislation. The main cases of a lawful refusal are as follows:
- non-compliance of documents with the requirements of the law (incomplete list, not properly certified copies, lack of necessary signatures, etc.);
- incorrect name of the cooperative apartment and its identification features (compared to data from the DRRP);
- at the time of application, the shares have not been paid in full;
- improper confirmation of the powers of the representative of the future owner (lack of a properly executed power of attorney).
