In commercial (economic) proceedings, compliance with procedural deadlines is one of the mandatory requirements for successful case consideration. Appeal and cassation in commercial proceedings: key aspects
To properly ensure the right to a fair trial, the law provides for appellate and cassation review. This is the stage where the decision of the lower court is reviewed and analyzed for violations of substantive or procedural law. The transition from one stage to another must occur gradually, as expressly provided by the Commercial Procedural Code of Ukraine. However, the most common mistake that leads to refusal to open appellate or cassation proceedings remains missing the deadline for filing the complaint and its attachments. What is the deadline for filing an appeal or cassation complaint in commercial proceedings?
The deadlines for filing complaints are relatively short, and their calculation usually begins from the date of pronouncement of the decision (full text). An appeal against a decision of the court of first instance that has not yet entered into legal force must be filed within 20 days from the date of its pronouncement. A cassation complaint must be filed within 20 days from the date the full text of the court decision is prepared. If the last day of the deadline falls on a non-working day, the deadline is extended to the first working day following it.
How can the deadline for appeal/cassation be restored in commercial proceedings?
Current national legislation clearly distinguishes between restoration and extension of deadlines. In the case of restoration, a strict procedure must be followed — filing a motion to restore the deadline for appeal or cassation (indicating valid reasons for missing the deadline), submitting the appeal or cassation complaint together with the motion, and obtaining a court ruling on restoration of the deadline and opening of proceedings in the commercial case. The motion should also be accompanied by documents confirming the validity of the reasons for missing the procedural deadline, including:
- medical certificates confirming health conditions;
- envelopes with the date of delivery;
- orders on business trips.
What reasons for restoring a procedural deadline may be recognized as valid?
The court independently evaluates whether the reason is valid and decides whether to restore the deadline. The current Commercial Procedural Code of Ukraine does not contain an exhaustive list of such circumstances. However, legal practice identifies the following as commonly accepted valid reasons:
- untimely receipt of the first-instance court decision (for example, due to technical failures in the “Electronic Court” system);
- circumstances arising from martial law (while the mere existence of martial law is not automatically considered sufficient grounds);
- objective obstacles preventing a physical person from filing a complaint (serious illness requiring inpatient treatment, death of close relatives);
- force majeure circumstances (natural disasters and other extraordinary events).
