Issuance of an Opinion on the Extension of the Deadlines for Settlements for Certain Transactions on the Export and Import of Goods Established by the NBU
The Ministry of Economy of Ukraine, at the request of citizens, may issue an opinion on the extension of the terms of settlements for export and import transactions established by the National Bank (hereinafter referred to as the conclusion).
According to the law, today the deadline for such transactions is exactly one year, but in some cases you can apply for their extension.
The main legislative framework in this matter will be the Order of the Ministry of Economy No. 329 and the Resolution of the Cabinet of Ministers of Ukraine No. 104.
The need to obtain such a conclusion arises in cases where citizens work with long-term or specific contracts in the field of foreign economic activity.

When is the conclusion on the extension of the deadlines for settlements for individual transactions issued?
The studied conclusion, which in its essence should be considered as a part of currency control, is provided in the case when standard settlement terms cannot be observed.
In particular, such cases are:
- production cooperation;
- consignment;
- joint construction project;
- tender deliveries;
- warranty service.
In each case, citizens and companies need to prove the need to deviate from standard settlement terms, taking into account the peculiarities of their international contract.
What documents should be provided to obtain an opinion on the extension of the deadlines for settlements for individual transactions?
To extend the deadlines for settlements for foreign economic transactions, it is necessary to apply to the Ministry of Economy with an application of the appropriate form (established in Order No. 329) and annexes to it.
Mandatory documents here will be:
- firstly, a foreign economic agreement (its copy);
- secondly, documents confirming the business transaction (for example, customs declarations, acts of work, etc.);
- thirdly, documents to substantiate the reasons for the delay in the implementation of specific import or export operations (letters or messages translated into Ukrainian and certified by your signature).
Important! If everything is in order with the submitted documents and they fully justify the need to issue an opinion on the extension of the deadlines for settlements for certain transactions on the export and import of goods established by the NBU, then the Ministry of Economy makes an appropriate decision within 10 working days.
It will also be published on the official website of the state body.
Peculiarities of filling out an application for an opinion: Order of the Ministry of Economy No. 329
A statement, given its importance, plays a decisive role in making a decision in a case.
As specified in Order No. 329, it must contain the following mandatory details:
- the name of the company or citizen of the resident, his location and contacts;
- the number of the bank account through which the relevant transaction is carried out;
- information about the non-resident (name, address, details);
- number of the foreign economic agreement, date of conclusion;
- the total amount and currency of the agreement;
- number of the preliminary conclusion on the extension of the settlement terms (if any).
When can they refuse to obtain an opinion on certain transactions on the export and import of goods established by the NBU?
The Ministry of Economy sends a notice of refusal to issue a conclusion if:
- the application contains inaccurate information;
- a discrepancy between the export or import transaction is revealed;
- documents do not meet the requirements of the law in terms of their form and content;
- all documentation was signed by a person who does not have the authority to do so;
- The resident company is not registered in the Unified State Register or is in the process of terminating its business activities.
Important! Refusal may also come if your transaction is carried out with goods included in the list, for which applications for the issuance of an opinion remain without consideration.
