Weapons permit
In wartime, the issue of security becomes especially relevant, and the right to self-defense becomes extremely important. At such times, individuals prone to committing criminal acts try to take advantage of the circumstances arising from martial law, which is why people are looking for ways to protect themselves and their families, and one of these ways is to obtain a weapons permit, since this solves the issues of self-defense and the increased level of crime in the country. It should be noted that this is not only a right, but also a high responsibility that requires careful preparation and knowledge.
In this article, we will study the importance of obtaining a weapons permit for civilians in wartime. We will consider the legislative regulation of this issue, the procedures for obtaining licenses, the requirements for individuals wishing to legally own weapons and obtain a permit for them.
Let’s start with obtaining a permit for a traumatic weapon. Such a permit can be obtained by a certain circle of people who have reached the age of 21, namely:
- persons working in court, representatives of law enforcement agencies and their close relatives;
- persons participating in criminal proceedings;
- people’s deputies of Ukraine;
- members of public formations for the protection of public order and the state border;
- military personnel, except for those doing compulsory military service;
- civil servants;
- journalists.
What about civilians not included in this list?
The issue of obtaining a permit for weapons for ordinary civilians arose sharply during the outbreak of a large-scale war, so the legislator promptly responded to such challenges and therefore the process of obtaining hunting firearms and cartridges for them was significantly simplified in accordance with the order of the Ministry of Internal Affairs № 170 of 01.03.2022.
The following should be noted here.
Smooth-bore hunting weapons can be owned from the age of 21, but when a person turns 25, he will have the right to obtain a permit for a hunting rifled weapon.
If a person who has not yet reached the age of 25, but is already an adult (18 years old), then he has the right to acquire a pneumatic weapon without any permits, but with a caliber of less than 4.5 mm and the bullet speed must be less than 100 m/sec. Also, persons over 18 years old can acquire a revolver and a pistol chambered for Flobert cartridges. The fact is that the circulation of the above-mentioned means of self-defense is not regulated by the legislation of Ukraine.
Now let’s discuss the process of obtaining a weapons permit.
To obtain a weapons permit (rifled hunting firearms, smoothbore weapons, pneumatic weapons, cold and blank weapons) in the manner prescribed by law, you must apply to the head of the national police agency at your place of registration/residence with a pre-prepared package of documents and submit an application.
Consulting a lawyer to obtain a weapons permit in a military conflict is of key importance for several reasons:
- Knowledge of legislation: A lawyer specialized in this area has experience in legally resolving the client’s issues, has deep knowledge of the legislation, which allows him to accurately understand the rights and obligations associated with obtaining a permit for a weapon in martial law.
- Expert assistance: A lawyer can provide expert assistance in complex issues, such as the process of obtaining a license, resolving conflict situations with law enforcement agencies or in court proceedings.
- Minimizing risks: Contacting a lawyer allows you to minimize the risks of violating the law and incorrect actions that can lead to the loss of a permit for a weapon or even criminal liability.
- Representation and protection of interests: A lawyer can act as a representative of the client in interactions with military and law enforcement agencies, as well as in court proceedings, protecting the interests of the client and ensuring compliance with his rights.
In conclusion, we would like to emphasize the importance of obtaining a weapons permit in a military conflict. This right to self-defense becomes an important element of security and protection of the person and property in the conditions of an escalation of war. However, in order to successfully obtain a permit and use it accordingly, legal expertise is required.
Contacting a lawyer in this matter is indispensable. A qualified lawyer has not only deep knowledge of the law, but also experience in solving complex legal issues related to obtaining a weapons permit. He will provide you with professional support at every stage of the process, minimizing risks and ensuring that your right to security is respected.
Thus, obtaining a permit for weapons in the conditions of a military conflict is an important and responsible matter that requires a professional approach and legal expertise. Contacting a lawyer will help you ensure your safety and protect your interests in this extremely important matter.
So, a weapons permit is a multi-stage and rather bureaucratic procedure, so contacting a qualified lawyer is an important step for successfully obtaining a weapons permit under martial law, ensuring the safety and protection of the client’s interests.
