Immigration to Italy
Italy is a country with a rich culture, history, and favorable climate, attracting many foreigners and offering opportunities for comfortable living, working, and integrating into European society. “Prikhodko&Partners” Law Firm provides professional support on immigration to Italy. Our lawyers advise on Italian migration law, helping you navigate the procedures for obtaining a residence permit, temporary protection, and citizenship.
What are the options for arranging a stay in Italy?
Immigration to Italy offers several options for legal residence. The main ones are temporary protection in Italy, a residence permit in Italy, and Italian citizenship. Temporary protection is suitable for rapid legalization, especially for Ukrainian citizens who crossed the Ukrainian border after February 24, 2022. It allows them to live, work, and receive medical care without the requirement to prove their residence in Italy on other grounds, which would require a more extensive set of documents.
A residence permit in Italy, the first step toward citizenship, is issued for reasons such as work, study, or family reunification. A temporary residence permit is valid for a limited period but can lead to permanent residence. Italian citizenship is the highest level of integration, which grants rights and also requires compliance with conditions regarding the length of residence in the country, as well as integration into its society.
Temporary protection as the easiest way to legalize
Temporary protection in Italy is the simplest immigration route for Ukrainian citizens. Introduced by an EU Directive due to the war in Ukraine, it applies to individuals arriving after February 24, 2022. Registration occurs at the questura or through an online portal, where permesso di soggiorno per protezione temporanea is issued. This document allows residence in Italy for up to 4 years, with the possibility of extension.
The advantages of this option include the right to work, access to education, healthcare, and social assistance. Our lawyers recommend submitting your application immediately upon entering the EU to avoid fines for illegal overstay in the Schengen area and to minimize the risk of application denial. After expiration, temporary protection can be converted into a residence permit in Italy.
What are the grounds for obtaining a residence permit (permesso)?
Residence permits in Italy are issued for specific reasons in accordance with Italian law. The main ones include:
- Work: Contract with an Italian employer or self-employment, with quotas for non-EU citizens.
- Education: Enrollment in a university or course, with extension based on the student’s performance.
- Family reunification: For relatives of Italian citizens or residents, including spouses and children.
- Business or investment: Opening a company with a business plan in Italy or investing in the economy.
- Humanitarian grounds: For victims of persecution or refugees, except for temporary protection.
For Ukrainian citizens, temporary protection often serves as the basis for applying for a residence permit. Documents are submitted to the Questura office at their place of residence, with an apostille and translation. Our migration lawyers in Italy help assemble the complete application package and support the process of submitting it to government agencies.
When is a permanent residence permit issued?
A permanent residence permit in Italy (carta di soggiorno UE) is issued after 5 years of continuous legal residence with a temporary residence permit.
Conditions: stable income (not below the minimum), knowledge of Italian (level A2), no criminal record and integration into society. For Ukrainian citizens who started with temporary protection, the transition is possible after converting to a temporary residence permit.
A permanent residence permit in Italy grants unlimited rights to live, work, and travel within the Schengen Area. It is not dependent on an employer or sponsor. Its main advantage is that, after 4–10 years of obtaining it, it provides a direct path to Italian citizenship.
How to obtain Italian citizenship?
Italian citizenship is obtained through naturalization or marriage. Naturalization requires 10 years of legal residence (5 for EU citizens, 4 for married couples), knowledge of the B1 language, an appropriate income level, and integration into Italy. The application is submitted to the prefecture, which includes an examination and verification. For Ukrainian citizens, service in the Italian army or special merits reduces the required time for residency in Italy.
Italian citizenship by marriage is possible after two years of cohabitation in the country (3 years abroad) with an Italian citizen. The marriage must be registered in Italy, stable, and share a common household. The procedure requires the preparation of documents both in Ukraine and abroad, and requires the submission of a full set of documents to the consulate or prefecture, followed by an interview.
Each of the options for formalizing residence has its own complexities and requires careful preparation of documents and compliance with legal requirements. “Prikhodko&Partners” law firm offers comprehensive support for those planning to immigrate to Italy.
