Registration of trademarks

Trademarks are generally marks used to distinguish the services or goods of one manufacturer from the services or goods of another manufacturer. Trademarks can be: verbal images (a set of letters, a word, a word combination), an image (icon, picture) or a combination of an image and words. Documents regulating the registration of trademarks

The manufacturer of one or another product must go through the trademark registration procedure in order for his product to acquire legal significance. All this is regulated by international treaties that are in force in Ukraine in relation to trademarks:

Agreement on the International Classification of Services and Products for the Registration of Trademarks (Nice Agreement).
Treaty on the Laws of Trademarks.
Agreement on the International Registration of Marks (Madrid Agreement).
Convention on the International Registration of Marks.

All the above documents and agreements have been ratified by Ukraine. As far as Ukrainian legislation is concerned, the registration of trademarks is governed by the Law of Ukraine No. 3689 “On the protection of rights to marks for goods and services”.

Peculiarities of trademark registration in Ukraine
