Legalization of foreigners in Ukraine

Entry rules for foreigners
To enter Ukraine foreigners need:
- a valid passport;
- proof of the purpose of the visit (e.g., an invitation or a reservation);
- sufficient funding, confirming that the person has adequate funds to cover their trip;
- insurance policy with war risk coverage.
If the country from which a foreigner is arriving does not have a visa-free regime with Ukraine, a visa is required. Depending on the purpose of the visit, it may be short-term, long-term, or transit.
If the country is a visa-free country, you can stay for up to 90 days out of 180 without a visa. If you plan to stay longer, you will need a visa, depending on the reason for your stay in Ukraine.
Ways of legalization
For a foreigner to legalize their stay in Ukraine, they must have a legal basis for their stay. Common grounds for legalization include:
- work;
- education;
- business;
- family reunification;
- volunteer activities, etc.
Therefore, it is necessary to obtain the appropriate permit (for example, a work permit or immigration permit) and a residence permit, which can be temporary or permanent. To do this, documents are submitted to the State Migration Service (SMS).
To obtain a residence permit, you must have a type D visa. Exceptions are made for citizens of Azerbaijan, Belarus, Armenia, Georgia, Moldova, and Uzbekistan.
Extension of stay
Sometimes situations arise where a foreigner does not want to obtain a residence permit but needs to stay in Ukraine for specific reasons. This can be done if there are grounds for doing so.
To extend their stay in Ukraine, a foreigner must submit an application and documents to the State Migration Service at their place of residence. This must be done no later than three business days before the legal expiration date. Generally, a stay in Ukraine without a residence permit is extended for the following reasons:
- for medical treatment;
- for childbirth;
- for caring for a sick person;
- due to emergency circumstances;
- for obtaining residence/citizenship documents.
It’s crucial to properly prove the necessary grounds for staying. The process itself involves submitting documents to the territorial office/subdivision of the State Migration Service.
