How to get a work permit in Romania?

DOCUMENTS THAT GIVE THE RIGHT TO WORK IN ROMANIA

In general, there are several main types of work permits for foreigners in Romania:
- permanent employees;
- seasonal workers;

Permanent employee – a foreigner working in Romania under an individual contract for an indefinite period or for a fixed period concluded with an employer on the basis of a work permit.
Intern – a foreigner working on the territory of Romania on the basis of a vacancy announcement, holder of a diploma of higher education or forms of higher education in a third country, participating in an internship program on the territory of Romania with the aim of improving professional training or obtaining professional qualifications, as well as improving linguistic and cultural knowledge
Seasonal worker – a foreigner who maintains his main place of residence in a third country, but legally and temporarily resides in Romania, working with an individual fixed-term employment contract concluded with the employer on the basis of a notice of employment, in order to ensure activities taking place in accordance with a certain time of the year.
Cross-border worker – a foreigner, a citizen of a state that has a common border with Romania and lives in the border zone of the corresponding state, working in a border town on Romanian territory under an individual contract for an indefinite or limited period, concluded with an employer on the basis of a work permit.
Highly qualified worker – a foreigner working in Romania in a highly qualified job with an individual contract for an indefinite period or a fixed period of at least one year, concluded with the employer on the basis of a work permit.
Housekeeper – a foreigner temporarily working in a host family in Romania to improve their language skills and competencies in exchange for simple help with housework and childcare.
Who can be hired in Romania?
In order to officially find a job in Romania, it is necessary to comply with a number of conditions fixed at the legislative level, among them:
- residents of Romania or the EU do not apply for this vacancy;
- you have the appropriate qualifications, education, skills and work experience;
- you are medically fit to work at the job;
- you do not have a criminal record incompatible with the work you intend to do in Romania;
- you fall within the annual quota approved by the decision of the Government;
- the employer has no unpaid obligations to the state;
- the employer is engaged in activities that are compatible with the job for which you are hired;
- the employer within the last 6 months has not been held liable for violation of the law, in particular, for undeclared workers or organizing illegal employment of citizens.

Conclusions. Do Ukrainians need a work permit in Romania?
During the war, no. Local authorities reported that Ukrainian citizens could be granted access to the Romanian labor market under the following conditions:
- on the basis of a long-term work visa for a maximum of nine months in a calendar year, without the need to obtain a work permit;
- after nine months on the basis of an extension of a valid visa and after obtaining a work permit;
- if submitting an asylum application, three months after the submission of the asylum application, during the entire period of the asylum procedure.
If necessary, a work permit for a natural person must be obtained by a Romanian employer, and not directly by the person.
However, a person who has been granted temporary protection under the Temporary Protection Directive will be able to work in Romania without a work permit.
If you want to work in accordance with your qualifications and specific specialty (please note that supporting documents legalized in accordance with EU rules are required for doctors, pharmacists, architects), but you do not have diplomas, attestations, certificates legalized in accordance with EU rules, you need to fill out declaration on your own responsibility, where you need to indicate that you have no criminal record and have been trained, have experience in this area.
Other documents required for employment:
- summary (it is recommended to provide in English);
- identity card (for drawing up a contract);
- diplomas, certificates, recommendations for previous jobs (it is recommended to provide these documents in English);
- certificate of granting the status of a seeker of international protection.

Yes. During registration, you must provide a document confirming the right to use the premises at the address of the future registered office. For foreign owners, this can be a lease agreement or a legal address service.
Is it necessary to immediately register as a VAT payer?
Not always. The need for VAT registration depends on the planned turnover, type of activity, work with EU clients, imports or exports, and other specifics of the business model. Before launching, it is worth assessing the tax burden and choosing the optimal registration option.
Why shouldn't you just add all possible CAEN codes to the company?
Activity codes affect not only formal registration but also bank compliance, contracts, obtaining permits, and further business scaling. From 2025, the CAEN Rev. 3 classifier is applied in Romania, so the list of codes is better formed according to the actual sources of income and the planned work model.
