State registration of ownership of real estate
The procedure for state registration of rights to real estate is an integral part of legal regulation in the field of real estate in Ukraine. The Law of Ukraine “On State Registration of Real Estate Rights and Their Encumbrances” establishes the procedure and conditions for recognizing and confirming rights to real estate objects, including the right of ownership, use, mortgage, easement, lease right and other real rights. It is through state registration that these rights acquire legal force and are subject to protection in accordance with current legislation.
The right of ownership to real estate is recognized only after making a corresponding entry in the State Register of Real Estate Rights. The only official confirmation of the existence of such a right today is an Extract from this register. This is an electronic or paper document that contains data about the real estate object, the owner, existing encumbrances, restrictions, prohibitions or other legal circumstances.
Previously, owners received a Certificate of Ownership, but after 2016 the system changed. The extract from the State Register has replaced all previous forms of confirmation and has become the only legal document in this area. You can obtain an extract online or through the Central Registration Service, a notary, or other authorized bodies that have access to the register.
How to check registration?
Anyone can check information about real estate through the official portal of the Ministry of Justice of Ukraine – using the electronic search service in the State Register. To do this, you need to have certain information, for example, the cadastral number, address or full name of the owner.
Application processing times
According to the law, registration begins on the day the application is submitted. The standard time for processing documents is up to five business days. However, urgent processing is possible for an additional fee. This mechanism allows you to reduce the time to two or even one business day.
Forms of submission of documents
Documents can be submitted:
- In paper form through administrative service centers or notaries.
- In electronic format through online services of the state portal.
As a result of submitting an application, two options are possible:
- Successful registration, after which an extract is generated.
- Refusal to register, which must be duly justified in accordance with the requirements of the law.
Rights subject to state registration
Mandatory registration includes:
- The right of ownership of any real estate object.
- Derivative real rights, in particular: The right to permanent use of a land plot; Mortgage (pledge of real estate); Easement (the right to limited use of someone else’s property); The right of lease and superficies (the right to build); Emphyteusis (the right to use someone else’s land for agricultural purposes).
Who has the right to register?
According to the legislation, state registration can be carried out by:
- Notaries who have access to the State Register.
- Entities accredited by the Ministry of Justice.
- Local government bodies that have received the appropriate powers.
What documents are required?
If registration is carried out on the basis of a court decision, it is necessary to provide:
- A copy of the court decision that has entered into legal force.
- An identity document (passport).
- Identification code.
- A receipt for payment of the administrative fee.
When can registration be refused?
The law provides for a number of reasons for which a decision on refusal may be made:
- The submitted documents do not comply with the established forms or contain inaccuracies.
- A conflict or duplication of property rights has been detected.
- Encumbrances or prohibitions have already been registered on the object.
- There is no sufficient evidence of the acquisition or termination of rights.
- The person is included in the Unified Register of Debtors.
