What are the legal grounds for searching for military personnel?
The already mentioned Law “On Mobilization Preparation and Mobilization” sets forth the obligations of citizens regarding military registration and mobilization. And Resolution № 560 regulates the procedure for maintaining records in the event of its violation by a person liable for military service. Consequently, the TCC and JV have the authority to search for persons evading military registration or mobilization activities.
What categories of persons are subject to search?
The following categories of military personnel are subject to search:
- those who did not appear at the TCC and JV after receiving a summons;
- those who did not register for military service, having changed their place of residence or work;
- citizens who deliberately avoid mobilization by hiding their own location.
Search measures may be applied to all of the listed categories.
What are the powers of the TCC and JV in the search process?
Authorized officials of the TCC and JV may send inquiries to state and local government bodies, as well as employers, regarding the whereabouts of persons liable for military service during the search process. Interaction with the National Police in order to establish the whereabouts of persons who are hiding also falls within the competence of the TCC and JV. In addition, they can use databases to check registration, border crossings, and changes in documents. Thus, representatives of the TCC and JV have a fairly broad range of powers in the matter of influencing persons liable for military service who evade compliance with the rules of military registration.
What is the liability for evasion?
If we talk about administrative liability, we are talking about quite significant fines under Article 210-1 of the Code of Ukraine on Administrative Offenses. These fines are calculated in amounts from 17 to 25.5 thousand hryvnia. This may also be criminal liability in the form of imprisonment based on Article 336 of the Criminal Code of Ukraine. As for criminal liability, it applies to persons from among the reservists who evade conscription for military service during a special period.
In addition to the listed types of administrative and criminal liability, additional sanctions in the form of cancellation of some permits may be applied to a conscript who violates the registration rules. There may also be problems with employment. And the person may also face restrictions on traveling abroad.
What to do if you are wanted?
If representatives of the TCC and JV have added a conscript to the wanted list, the following step-by-step algorithm should be followed:
- Establish the reason for the search
In order to plan further actions, it is necessary to understand why the conscript was wanted. For example, he could have failed to show up for a summons without a valid reason. Another reason could have been the absence from the place of registration when representatives of the TCC and JV (or law enforcement agencies) conducted an inspection. Often, conscripts are also wanted for failing to promptly update information about their place of residence, marital status, etc.). And finally, it is worth mentioning evasion of mobilization.

Once the data is updated, the basis for the search may be cancelled and the search case closed.
What is the result of being removed from the wanted list?
If a person is removed from the wanted list, the TCC and JV issue a corresponding order or service certificate to this effect. The information is then submitted to the National Police and the State Border Service so that the person can be excluded from the database. And the conscript himself receives official confirmation that his wanted status has been removed.
