Legalization of a modular gas station is the process of bringing it into compliance with the requirements of the law. It involves the correct commissioning of the gas station and obtaining permits to carry out activities related to the storage and sale of fuel from it for commercial purposes or for personal needs. Modular gas station: concept and some requirements for installation
A modular gas station is a mobile and compact system for storing and dispensing fuel. It consists of ready-made functional blocks and can be easily installed both at industrial facilities and in settlements for refueling your own transport. Its installation requires compliance with strict rules arising from current state building codes (for example, DBN B.2.2-12:2018). This involves:
- first, finding a suitable area for such installation;
- second, laying a foundation under the modular gas station (with a height of 0.2 meters);
- third, compliance with permissible distances to other objects (residential buildings, administrative premises, kiosks, educational institutions, etc.);
- fourth, compliance with fire safety requirements.
How to legalize a modular gas station in Ukraine: the main procedure
Obtaining a certificate of acceptance of the facility into operation
After completing the construction of a modular gas station, it is necessary to obtain a certificate of acceptance of the facility into operation. This is a mandatory document that confirms that the gas station meets all building codes and safety requirements. The entire process of obtaining it takes place electronically through “Diya” and involves submitting the following package of documents:
- application for a certificate;
- act of readiness of the facility for operation (the form is established in the Resolution of the Cabinet of Ministers No. 461).
After that, DIAM (State Inspectorate of Architecture and Urban Planning of Ukraine) checks the compliance of the modular gas station with the requirements of current national legislation (in this case, additional receipt of urban planning conditions and restrictions may be required) and enters the relevant information into the Register of Construction Activities.
Obtaining a permit to perform high-risk work
Installation and operation of fuel storage facilities are considered high-risk work, and modular gas stations are objects of the CC3 consequence class. Therefore, for their legalization, it is also necessary to additionally obtain a special permit from the State Labor Service of Ukraine by providing:
- a statement of the established form (for more details, see Resolution of the Cabinet of Ministers of Ukraine No. 1107);
- an expert opinion on the compliance of the equipment with the requirements of labor protection legislation.
Obtaining a license for fuel storage
Finally, after all the steps described above, the next stage is to submit documents to the tax service for a license to store fuel. Such a license can be of two types:
- the first is for those who store fuel for commercial purposes (offering it for sale to third parties);
- the second is for enterprises that store fuel only for their own consumption or industrial activities.
A license is obtained for each fuel storage location, that is, the location of a modular gas station. To obtain it, you must submit an appropriate application and a package of documents, which will include:
- a copy of a document confirming the right of ownership or use of a land plot under a modular gas station;
- a copy of the certificate of acceptance into operation;
- a permit from the State Labor Service for performing high-risk work and operating equipment;
- a receipt for payment of the state duty for issuing a license.
