Legal basis of accounting in Portugal
The Portuguese accounting system is based on legislation harmonized with European directives and standards.
The main regulatory acts are the Commercial Code (Código das Sociedades Comerciais) and Decree-Law No. 134/2012, which gives the Accounting Standardization Commission (CNC) the power to establish accounting standards.
The Standardization Accounting System (SNC) sets different reporting requirements depending on the type and size of the company, providing a flexible approach to business needs.
Types of accounting and tax regimes
Simplified regime (Regime Simplificado)
This regime automatically applies to self-employed individuals with an income of up to €200,000 per year.
Its key feature is the application of coefficients to determine the tax base.
For example, for professional activities, only 75% of income is subject to taxation. This significantly reduces the tax burden, but does not allow for full consideration of expenses. If expenses exceed 25% of income, it is advisable to switch to an organized regime.
Organized mode (Organized Accounting)
This regime is mandatory for incomes over €200,000 or can be chosen voluntarily. It requires full accounting with the involvement of a licensed accountant (Técnico Oficial de Contas).
Enterprises are divided into categories:
- Microenterprises — turnover <700,000 €, assets <500,000 €, <10 employees
- Small businesses — turnover <4,000,000 €, assets <2,000,000 €, <50 employees
The organized regime involves accounting for all income and expenses in accordance with SNC standards, as well as submitting reports to tax authorities.
Special modes
The Non-Resident National Housing (RNH) regime, which provides tax benefits, plays a special role. Although new registrations under the regime are suspended from March 31, 2025, current residents can use it for 10 years.
Digitalization and modern requirements
The Portuguese accounting system is one of the most digitalized in the EU.
The central role is played by the SAF-T (Standard Audit File for Tax) system, a standardized electronic reporting format in XML format transmitted using certified software.
SAF-T files are submitted:
- Monthly — by the 5th of the following month (invoices)
- Annually — together with the corporate tax return
- On demand — during tax audits
Reporting and audit obligations
All companies are required to prepare annual financial statements (balance sheet, profit and loss statement). The deadline for submission is 30 days after the annual general meeting.
Audit is mandatory for:
- Public companies (SA)
- Private companies (LDA)if 2 out of 3 indicators are exceeded:
- Turnover > €3,000,000
- Assets > €1,500,000
- Employees > 50 people
