Entering an apartment in the real estate register
The State Register of Real Property is a legally significant source of information about ownership. Entering an apartment into this register involves transferring ownership data from paper documents into a nationwide electronic database. Starting from January 1, 2013, confirmation of apartment ownership requires an official extract from the register. In this article, we explain the procedure for registering an apartment in the State Register of Real Property.
Why is it necessary to enter apartment data into the State Register of Real Property?
Without a record in the register, real estate is effectively in a “blind zone” for the state. Therefore, entering this data into the database is not only desirable but necessary, including for the following reasons:
- protection against fraud (paper documents are much easier to forge);
- after registration, ownership information becomes part of a secure state system;
- unhindered access to state assistance programs, including the e-Recovery program;
- potential buyers prefer apartments that are officially recorded in the register;
- convenience and time savings (for example, during inheritance procedures).
What documents are required to register an apartment in the real estate register?
To ensure your apartment appears in the register, you need to prepare the following set of documents:
- identity documents (passport, tax identification number);
- a title document for the apartment (contract, certificate, court decision);
- technical documentation (BTI ownership certificate, technical passport);
- identity documents of another co-owner (if applicable).
Registering an apartment in the State Register of Real Property: what does the procedure look like?
Today, the owner may choose between online registration and applying to a notary (or another state registrar). Although the first option is the fastest, our lawyers recommend the second, as it helps avoid procedural errors. Overall, the procedure for entering new data into the real estate register includes the following steps:
- preparation of originals or certified copies of the required documents;
- visiting a state registrar and completing the standard application;
- certification of a power of attorney for the owner’s representative (if required);
- payment of the administrative fee for registering new data;
- obtaining an official extract.
When can registration of an apartment in the State Register of Real Property be denied?
There are cases when registration of an apartment is denied. This may occur due to specific reasons established by current national legislation. First, if it is impossible to identify the applicant or if the representative lacks proper authority to perform registration actions. Second, if the property was оформed before 2013 and the BTI did not confirm the existence of records in older registries upon the registrar’s request. Third, if the property has already been registered to another person (double registration or raiding). To learn how to amend the register in such cases and avoid negative consequences, we recommend requesting a consultation with our real estate lawyer.
How can a real estate lawyer help you?
In 2026, the real estate market has become fully digital, and legislation more dynamic. A real estate lawyer from “Prikhodko & Partners” not only provides consultations and reviews documents but also accompanies the entire apartment registration process in the national database — from start to completion. Taking into account extensive practical experience and professional qualifications, the lawyer can provide the following services:
- first, a comprehensive apartment review (debts, court cases, etc.);
- second, documentary support of the process (preparing certified copies, drafting a power of attorney, etc.);
- third, assistance with apartment registration in the State Register of Real Property through a notary or other registrar;
- fourth, assistance in obtaining a BTI information certificate (if required);
- finally, initiating corrections or amendments to previously registered real estate data.
Thus, entering apartment data into the State Register of Property Rights is not merely a formality, but a critically important step to protect ownership in Ukraine. Transferring data from paper documents to an electronic database ensures legal transparency, minimizes risks, and provides convenient access to state services. We recommend seeking legal support from a specialist at our firm, who can comprehensively assist you — from an initial consultation to obtaining an official extract from the state register.
